As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH FACILITY
The Borough facility designated for brush/tree material disposal is the Department of Public Works facility located at 37 Willowbrook Court. The Department of Public Works reserves the right to designate the specific location within the facility that brush/tree materials can be disposed of.
COMMERCIAL LANDSCAPER
A person or entity whose business involves the placing, planting, arranging, trimming, cutting, removing of trees or maintenance of lawns, trees, bushes, shrubs, gardens and related appurtenances on land or property for the purpose of improving or maintaining same.
RESIDENT
A person who currently resides in the Borough of North Haledon. Proof of residency shall include a current driver’s license, utility bill or tax bill.
VEHICLE
Every device in, upon or by which a person or property is or may be transported upon a highway.
All residents of the Borough of North Haledon will be allowed to dispose of brush/tree materials at the North Haledon Department of Public Works facility in designated areas without the need for a specific permit, provided they meet the following:
A. 
Any person disposing of brush/tree material at the North Haledon Department of Public Works facility must be a current resident of the Borough of North Haledon and provide proof of residency to the facility attendant prior to the disposal of any brush/tree material.
B. 
A resident must only dispose of brush/tree materials in the designated location at the Department of Public Works facility.
C. 
Tree stumps will not be accepted
D. 
Logs and branches shall be cut in manageable lengths as determined by the facility attendant.
E. 
A resident must personally dispose of the material at the Department of Public works facility. Commercial landscapers working on a North Haledon resident’s property is not granted access to disposal at the North Haledon Department of Public Works facility.
F. 
A resident may only dispose of the brush/tree material from their property utilizing a vehicle no larger than a standard pickup truck or a small trailer. Residents with trailers with an electric or a hydraulic dump mechanism must get a special permit at the Municipal Clerk’s Office to allow them to drop off brush.
G. 
The Borough reserves the right to refuse disposal of brush/tree materials for any reason if in the opinion same would be detrimental to the facility and its operation.
H. 
Brush/tree material disposal will only be allowed on Tuesday, Thursday and Saturday of any given week, during normal business hours of the recycling center. All other times brush/tree material disposal is prohibited.
Commercial landscapers are hereby prohibited from disposing of brush/tree materials at the Department of Public Works facility unless they are a current resident of the Borough of North Haledon disposing of brush/tree material from their residence and provide proof of residency to the facility attendant prior to the disposal of any brush/tree material in a vehicle no larger than a standard pickup truck or a small trailer without an electric or a hydraulic dump mechanism.
Any person or persons who shall violate or fail to comply with any of the provisions of this chapter, upon conviction thereof, shall be punished by a fine of not less than $100 for the first offense, not less than $100 and not to exceed $500 for the second offense and not less than $100 and not to exceed $1,000 for the third offense and/or the revocation of disposal privileges at the North Haledon Department of Public Works brush/tree material disposal facility.
