The office of Borough Manager is hereby created by and for the Borough of Kane.
The person filling the office of Borough Manager shall perform and exercise all the following powers and duties:
A. 
He/she shall supervise and be responsible for the activities of all municipal departments, except insofar as such supervision or responsibility or duties are expressly imposed upon some other Borough officer by statute. Requires knowledge of methods and equipment to maintain sound infrastructure in the Borough.
B. 
He/she shall hire and, when necessary for the good of the service, shall suspend or discharge all employees under his/her supervision, provided that persons covered by the civil service provisions of the Borough Code shall be hired, suspended or discharged in accordance with such provisions, provided, further, that he/she shall report, at the next meeting thereafter of Council, any action taken by authority of this subsection. Conduct an annual performance evaluation of office personnel and Street Department Foremen.
C. 
He/she shall prepare and submit to Council before the close of the fiscal year, or on such alternate date as Council shall determine, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, he/she, or an officer designated by him, shall obtain from the head of each department, agency, board, or officer, estimates of revenues and expenditures and other supporting data as he requests. He/she shall

He/she shall be responsible for the administration of the budget after its adoption by the Council. Oversees all departmental purchases.
E. 
He/she shall attend all meetings of Council and its committees, if required by the chairperson.
F. 
He/she shall prepare the agenda for each meeting of Council and supply facts pertinent thereto Work with committee chairpersons, when requested providing information in a timely manner.
G. 
He/she shall keep the Council informed as to the conduct of borough affairs; submit monthly reports on the condition of the borough finances and such other reports as the Council requests, and make such recommendations to the Council as he deems necessary Obtain annual audit of Borough finances.
H. 
He/she shall submit to Council, as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
I. 
He/she shall see that the provisions of all franchises, leases, permits and privileges granted by the Borough are observed. Responsible for Code of Ordinances enforcement and prepares resolutions and drafts of ordinances for Council's consideration.
J. 
He/she may employ, by and with the approval of Council, experts and consultants to perform work and to advise in connection with any of the functions of the Borough.
K. 
He/she shall attend to the administration, review and letting of contracts in due form of law, and he/she shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Borough Officer by statute.
L. 
He/she shall see that all money owed to the Borough is promptly paid and that proper proceedings are taken for the security and collection of all Borough's claims.
M. 
He/she shall be the purchasing officer of the Borough and he/she shall purchase, in accordance with the provisions of the Borough Code, all supplies and equipment for the various agencies, boards, departments and other offices of the Borough. Work in a collaborative manner with local organizations, state and county government to help provide services to the borough. He/she shall keep an account of all purchases and shall, from time to time or when directed by Council, make a full written report thereof. He/she shall also issue rules and regulations, subject to the approval of Council, governing the requisition and purchasing of all municipal supplies and equipment.
N. 
All complaints regarding services or personnel of the borough shall be referred to him/her. He/she, or an officer designated by him, shall investigate and dispose of such complaints and he/she shall report thereon to Council.
O. 
Act as a delegate, only, to K.A.I.D.C., actively pursue grants and low-interest loans for the Borough. Assumes other responsibilities as determined by Council.
The Council and the Mayor may delegate, subject to recall, at such time or times as the Council or the Mayor may desire, to the Borough Manager any of their respective nonlegislative and nonjudicial powers and duties.
The compensation to be paid to the person filling the office of Borough Manager shall be set from time to time by the Borough Council.
The aforesaid compensation shall be payable from the general funds of the Borough.
The compensation herein provided shall be subject to deduction for the purpose of payments into the Contribution Fund established by the General Assembly of the Commonwealth of Pennsylvania by Act 491 of the 1951 Session P.L. 1833, as amended or supplemented.
The person filling the office of Borough Manager shall give a bond to the Borough, with one bonding company approved to do business within the Commonwealth of Pennsylvania as surety thereon, to be approved by the Council, in the sum of $3,000.
Beginning at midnight of the day on which this article becomes effective and continuing thereafter until the office of Borough Manager is abolished.
