This Board of Trustees hereby finds and determines that the Village of Babylon is home to a large population of military veterans. The Board further finds and determines that the Village strives to assist veterans in meeting their needs, through services provided in the Retail Business District (§ 365-20), as well as providing veteran-specific benefits. The Board finds that many veterans visit the Retail Business District to obtain necessary services and interact with other veterans and government officials. The Board also finds that it would be appropriate to provide permits upon proof of honorable discharge that waives the on-street parking meter fee in the Retail Business District for veterans in recognition of their sacrifices to protect our nation's freedom. The Board further finds that the Board from time to time may regulate such parking in the terms and conditions. Therefore, the purpose of this article is to establish a parking permit program for veterans to park in on-street metered spaces and in designated municipal lots in the Retail Business District.
A. 
This permit is available to all Babylon Village resident veterans that have served in the military during a war or a congressionally approved combat conflict period. Active military personnel and reservists are not eligible. Only those reservists discharged from active duty during a war or congressionally approved combat conflict period are eligible. The permit is for an automobile owned and registered to the resident veteran at an address within the Village. The permit must be renewed annually. Only one permit will be issued yearly to the resident veteran. The resident veteran must submit a copy of DD214, driver's license, the automobile's registration, and a deed. In lieu of a DD214, the Clerk may accept written certification from the United States Veterans Administration, the New York State Division of Veterans Services, or the Suffolk County Veteran Services Agency that the applicant is a war or congressionally approved combat conflict veteran. In lieu of a deed, the Clerk may accept a lease or bank statement.

The permit is also available to all Babylon Village resident veterans with disabilities that served in the military. In order for veterans with disabilities to receive the permit (without service during war or congressionally approved combat period), they must have received an Expeditionary Medal and have a disability rating. The permit is for an automobile owned and registered to the resident veteran with disabilities at an address within the Village. The permit must be renewed annually. Only one permit will be issued yearly to the resident veteran with disabilities. The resident veteran with disabilities must submit a copy of DD214, driver's license, the automobile's registration, and a deed. In lieu of a DD214, the Clerk may accept written certification from the United States Veterans Administration, the New York State Division of Veterans Services, or the Suffolk County Veteran Services Agency that the applicant is a veteran. In lieu of a deed, the Clerk may accept a lease or bank statement
Parking permits issued to resident veterans shall only be applicable to metered parking both on-street and in designated municipal lots within the Retail Business District for two hours, as set by the Board of Trustees in the terms and conditions.
The identification sticker issued by the Village Clerk shall be affixed permanently and displayed in full view at all times on the outside of the left rear window of the vehicle. The license number on the identification sticker shall correspond to the number of the license plate of the vehicle on which it is displayed.
In the event of damage or destruction to a sticker, a replacement must be obtained from the Village Clerk and the damaged sticker must be immediately replaced. The Board of Trustees shall set parameters for the replacement of stickers in the terms and conditions.
Parking permits are nontransferable and are valid for only one vehicle. Such permits shall automatically terminate when the holder thereof is no longer a Village resident.
In the event of a change in registration or purchase of a different vehicle or change in residency, said sticker must be surrendered immediately to the Village Clerk.
A permit for veteran parking shall be used in strict compliance with the terms and conditions of this permit. Any violation by its holder of any terms or conditions shall constitute grounds for revocation by the Village Board or its authorized representatives.
The terms, conditions, regulations and fee upon which any identification sticker is issued by the Village Clerk shall be as authorized in resolutions adopted by the Board of Trustees from time to time. The Village Clerk will maintain a schedule of regulations relating to identification stickers, their transfer, replacement and issue of additional stickers for vehicles.
Any person found guilty of a violation of any of the provisions of this article shall be punishable by a fine of not less than $15 nor more than $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment.
A permit for veteran parking does not exempt, except, provide a defense or otherwise allow conduct violative of federal, state or local laws and regulations, including but not limited to this Code.
If any clause, section, or other part of this article shall be held invalid or unconstitutional by any court of competent jurisdiction, the remainder of this article shall not be affected thereby, but shall remain in full force and effect. All local laws in conflict herewith are hereby subordinated to this article.
