The Township of Lacey hereby adopts the BOCA National Property Maintenance Code, Fifth Edition, 1996, as the Property Maintenance Code of the Township of Lacey for the control of buildings and structures as herein provided; and each of and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted and made a part hereof, as if fully set forth in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 273-2 of this article.
The BOCA National Property Maintenance Code is amended, revised and supplemented as follows:
A. 
Section PM-101.1 shall be amended to provide as follows: "These regulations shall be known as the 'Property Maintenance Code of the Township of Lacey,' hereinafter referred to as 'this code.'"
B. 
Sections PM-106.2 and PM-106.3 shall be deleted in their entirety.
C. 
Section PM-107.4 shall provide as follows:
PM-107.4 Penalties: Penalties for noncompliance with orders and notices shall be as set forth in Chapter 273 of the Township Code of the Township of Lacey.
D. 
Section PM-108.2 shall be amended to include the following sentence: "All actions of the code official in taking action to close the premises shall be in accord with the requirements of Chapter 149 of the Township Code of the Township of Lacey."
E. 
Section PM-108.3 shall be amended to provide as follows:
PM-108.3 Notice and hearing: All notices to the owner of the premises shall be given in accordance with the requirements of Chapter 149 of the Township Code of the Township of Lacey. Any hearing afforded the owner of the premises shall be held in accordance with the requirements of Chapter 149 of the Township Code of the Township of Lacey.
F. 
Section PM-110.2 is hereby amended and supplemented to provide as follows:
PM-110.2 Notice and hearing: Prior to the issuance of any order pursuant to PM-110.1, the appropriate notice and hearing shall be provided to the owner of the premises in accordance with the provisions of Chapter 149 of the Township Code of the Township of Lacey.
G. 
Section PM-110.3 is hereby amended and supplemented to add the following sentence to the end of said section: "The code official shall follow the procedures set forth in Chapter 149 of the Township Code of the Township of Lacey in regard to the raising, demolition and removal of the structure and placing a lien against the subject premises to recoup the costs incurred by the township."
H. 
Sections PM-111.0 through PM-111.7 shall be deleted, and in their place inserted Sections PM-111.0 and PM-111.1, which shall provide as follows:
SECTION PM-111.0 MEANS OF APPEAL
PM-111.1 Any person affected by decision of the code official of a notice or order issued under this code shall have the right to appeal such determination to the Superior Court of the State of New Jersey in accordance with appropriate state statutes or court rules.
I. 
Section PM-202.0 shall be amended to provide for the following definitions for the terms "family," "one-family dwelling" and "two-family dwelling":
Family: One or more persons occupying a dwelling unit as a single nonprofit housekeeping unit, who are living together as a stable and permanent living unit, being a traditional "family" unit or the functional equivalency thereof.
One-family dwelling: A building containing one dwelling unit.
Two-family dwelling: A building containing two dwelling units.
J. 
Section PM-304.12 shall be amended so that the introductory phrase up to the first comma provides as follows: "During the period from May 15 to September 15."
K. 
Sections PM-602.2.1 and PM-602.3 shall be amended to delete the phrase "from [date] to [date]" and in its place insert "from September 15 to May 15."
L. 
Section PM-303.8 shall be amended to add, in addition to the existing provisions of Section PM-303.8, the following:

Motor vehicles, trailers and boats:
No currently unregistered or uninspected motor vehicle, trailer, boat, watercraft or vessel shall be parked, kept or stored on any premises. No vehicle, trailer, boat, watercraft or vessel of any type shall at any time be in a state of major disassembly, disrepair or in the process of being stripped or dismantled.
Exceptions: This shall not apply to an unregistered or uninspected vehicle, trailer, boat, watercraft or vessel that is stored in a garage or an approved accessory structure; nor shall this apply to any marina or boat sales or boat repair business, provided that all the Township permits for the operation of such a business have been acquired.
M. 
Any marina or boat sales or boat repair business, provided that all the township permits for the operation of such a business have been acquired. The major repair of a boat, watercraft or vessel by the owner of both the boat and the premises upon which it is located, provided that the major repair is completed within a six-month period.
A. 
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not less than $100 nor more than $1,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense
B. 
The violation of any provision of this article shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
