As used in this article, the following terms shall have the indicated meanings:
FILMING
The taking of still or motion pictures, either on film, videotape or similar recording medium, for commercial or educational purposes intended for viewing on television or in theaters or for institutional use.
PUBLIC PROPERTY
Includes Village streets, sidewalks and parking areas, Village beaches and parks, Village buildings and other public facilities.
No filming shall be conducted on private or public property in the Village of Southampton without first obtaining a permit therefor from the Mayor.
A. 
An application for such permit shall be filed in the Village Clerk's office. The application shall show the proposed site or sites involved, the nature of the proposed filming, the proposed date or dates involved and such other information as may reasonably be required. The applicant shall also supply the Village with proof of public liability insurance with policy limits of $500,000/$1,000,000.
B. 
The fee for such permit shall be as established from time to time by resolution of the Village Board of Trustees. Such Board may establish fees in different amounts, based upon the type of filming activity, the period of time (number of days) involved, the location involved and the cost of any necessary traffic control or other services. The fee for such permit shall be paid prior to issuance of such permit.
A. 
In determining whether to grant such permit, the Mayor shall consider whether the proposed filming activity may unduly obstruct traffic (vehicular and/or pedestrian) or create any other hazardous or injurious condition or unduly disturb the peace or good order of the neighborhood or the Village, and the Mayor shall consider whether the proposed filming activity is reasonable and suitable under the circumstances involved.
B. 
After considering the above standards, the Mayor may either grant such permit or refer the application to the Village Board of Trustees for a determination as to whether such permit should be granted or denied.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in Article II of Chapter 1 of the Code of the Village of Southampton.
