The Board of Supervisors of Springettsbury Township is hereby authorized to enter into the intermunicipal agreement as attached. Said agreement generally provides, as follows:
A. 
The municipalities shall create a five-member Board of Appeals, with the members being appointed by the York County Board of Commissioners.
B. 
All costs of appeals or hearings shall be paid first from the filing fee received by the Township, and the Township shall pay any remaining costs.
C. 
In the event there are any claims made against the Board of Appeals relating to its procedures or decisions, the county shall indemnify the Township for the costs of defending such claims and shall be responsible for any resulting liability.
D. 
This agreement shall be effective through the last day of 2005 and shall be automatically renewable for successive periods of one year, unless terminated by agreement of the municipalities.

Springettsbury Township shall enter into a charter agreement between Spring Garden Township and Springettsbury Township creating York Area United Fire and Rescue (the "Department") to provide fire services to an independent fire district consisting of the geographic area of the participating municipalities, as defined in the charter agreement.
The term of the agreement shall extend until December 31, 2017, and shall be automatically renewable from year to year thereafter, subject to termination by a vote of at least 2/3 of the Commission and passage of termination ordinances by at least 75% of the charter municipalities, as defined in the charter agreement.
The purpose of entering into such an agreement is to provide fire services to the participating municipalities.
The Regional Department shall be financed primarily through assessed funding from the participating municipalities adjusted over time by average-call history, as further defined in the charter agreement, plus such supplemental funding as may be available from time to time from other private and local, state, or federal government sources.
A. 
The Department shall be under the direction and control of the York Area United Fire and Rescue Commission ("Commission"), consisting, initially, of two representatives from Springettsbury, two representatives from Spring Garden, and one citizen-at-large. The citizen-at-large shall be appointed for a two-year term. This appointment shall be on a rotating basis between the charter municipalities. The citizen-at-large must be a resident of a charter municipality. Spring Garden Township shall appoint the first citizen-at-large for a two-year term.
B. 
Each charter municipality shall also appoint one alternate representative who may attend meetings and participate in discussions. An alternate shall not have the right to vote unless the appointed representative is absent from a Commission meeting. Contracting municipalities shall not have the right to appoint a voting representative, but shall appoint a representative to attend meetings and participate in discussions.
All real and personal property required shall be owned or leased by the Regional Department and managed by the Commission. In the event of dissolution of the Regional Department, all real estate, vehicles, equipment, materials and supplies owned or leased by the Department shall be appraised by appraisers appointed by the Commission for the purpose of determining fair market value. The Commission shall first pay all lawful debts and obligations incurred during its term of existence, and any reasonable reserve for same. Thereafter, the Commission shall pay to each charter municipality, in cash or in kind, a sum equal to the value of its initial capital contribution established pursuant to Exhibits A and B of the charter agreement. Lastly, the remaining assets, if any, shall be distributed to the charter municipalities, in like kind, in the same proportion as the funding assessments for the then current fiscal year. In the event that the Department's charter municipalities cannot agree upon an equitable distribution, in like kind, the assets shall be sold and the cash proceeds distributed in the foregoing proportions.
The Commission shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security, for its employees.
The Board of Supervisors of Springettsbury Township is hereby authorized to execute whatever documents may be necessary to carry out the express provisions and intent of this article, including, but not limited to, the charter agreement attached hereto as Exhibit A[1] and deemed incorporated as if fully set forth herein.
