[Adopted 2-27-2003 by Ord. No. 2003-04 (Ch. 18, Part 1B, § 18-133 of the 2003 Code)]
Based on the report of the Township's Sewer Engineers, dated November 19, 2002, the Board of Supervisors finds that the current aging Eden Road sanitary sewer pump station presently serving a section of the northwestern portion of the Township is past its useful life and needs completely replaced. The Board further finds that the most feasible means of addressing the problem is to replace the existing pump station with a new gravity sanitary sewer line, which will connect to the Township's Codorus Creek Interceptor and having sufficient capacity to service existing sewage flows and the projected future flow from property which is now unimproved. As the existing facilities are adequate for the present flows, it would be inequitable to impose the entire cost of the new sanitary sewer line upon either the present users within the affected area or upon all users of the Township's sewer system generally. It is, therefore, deemed to be in the public interest that landowners with unimproved lots in the subject area pay a reasonable charge to be applied to the necessary costs of constructing the new sanitary sewer line when making application for a building permit to improve any lot.
When used in this article, the following words, terms and phrases shall have ascribed to them the meanings herein set forth:
DISTRICT
The North Western Sanitary Sewer Collection System District established by this article.
EDU (EQUIVALENT DWELLING UNIT)
Any room, group of rooms, house, trailer or other structure or enclosure occupied or intended for occupancy as separate living quarters by a family or persons living together or by persons living alone. The volume of sanitary sewage generated by one EDU is stated to be 350 gallons per day.
LANDOWNER
The legal or beneficial owner or owners of land including the holder of an option or contract to purchase, a lessee if he is authorized under the lease to exercise the rights of the owner, or other persons having a proprietary interest in land.
UNIMPROVED LOT
A parcel of land unimproved with any building or structure required to be connected to the public sanitary sewer system.
There is hereby established in Springettsbury Township a special sewer district to be known as the "North Western Sanitary Sewer Collection System District." Said district shall be composed of the area shown on the Location Plan designated as Exhibit 1 attached hereto and made a part hereof.[1]

There is hereby imposed upon the landowner of each unimproved lot with the district a one-time fee or charge at the rate of $721, Exhibit 2[1] for each EDU of any building or structure erected on such lot which is required to be connected to the public sanitary sewer system and for which a building permit is obtained after enactment of this article. Said charge shall be paid at the time the landowner applies to the Township for a building permit for the construction of installation of such building or structure and the payment thereof shall be a condition precedent to the issuance of such building permit.

All revenue received by the Township from the fee or from the fee or charge imposed by this article shall be segregated from all other revenue of the Township and deposited in a separate and distinct account.
The revenue received by the Township from the fees or charges imposed by this article shall be expended and disbursed from the segregated account for the construction and installation of a new gravity sanitary sewer line with appurtenant facilities within the district only, and for no other purpose.
