The governing body of the municipality finds and declares that the New Jersey Department of Environmental Protection (NJDEP) adopted regulations regarding stormwater management and pollution control which are applicable to all municipalities within the State of New Jersey. These regulations require the municipality to develop, implement and enforce a stormwater pollution prevention plan. As part of this plan, the municipality is required to adopt regulations to control pollution of the waters of the state within its jurisdiction to protect the public health, safety and welfare.
It shall be the duty and responsibility of the Millville Police Department and the Streets and Roads Department to enforce the regulations contained in this chapter as herein provided.
Any person who shall violate any of the regulations contained in this chapter shall, upon conviction thereof, be subject to the penalties set forth in Chapter 1, General Provisions, Article III, of the Municipal Code of the City of Millville.
Each article, section or paragraph of this chapter is declared to be an independent article, section or paragraph, and the finding or holding of any portion of this chapter to be unconstitutional, void, or ineffective for any cause or reason shall not affect any other portion of this chapter.
Any ordinances or regulations of the municipality which are in conflict with the provisions set forth in this chapter are hereby repealed.
