The owner of every existing house, building or structure, which is or may be occupied or used by human beings, located on a street along the line of any sewer now or hereafter constructed in the Borough of Alpha shall, within 240 days after the date on which the services of such sewer are made available to such house, building or structure, install a toilet in such house, building or structure unless a toilet is now installed therein or shall have been installed therein prior to such date, and said owner shall, prior to such date, connect such toilet therein or so installed therein with the sewerage system of the Borough. Time extensions may be granted where hardship is proven to the satisfaction of the Borough Council.
The owner of every house, building or structure hereafter constructed, which may be occupied or used by human beings, located on a street along the line of any sewer now or hereafter constructed in the Borough of Alpha shall, within 240 days after the date on which the services of such sewer are made available to such house, building or structure, whichever date shall be later, install a toilet therein and connect such toilet installed therein with the sewerage system of the Borough.
If any such house, building or structure referred to in §§ 403-31 and 403-32 above shall be used for industrial or commercial purposes, the owner thereof shall, within 240 days after the date on which the services of such sewer are made available to such house, building or structure, whichever date shall be later, install such facilities as are necessary to accept and dispose of such industrial wastes emanating therefrom and connect such facilities with the sewerage system of the Borough under and pursuant to rules and regulations of the Borough.

If the owner of any house, building or structure referred to in §§ 403-31, 403-32 and 403-33 of this article shall fail to make any installation or connection required by this article within the time herein required, the Borough may proceed to make such installation or connection, or cause the same to be made, and assess the cost thereof as a lien against such house, building or structure, pursuant to N.J.S.A. 40A:26A-1 et seq.

A. 
The installations and connections required to be made pursuant to the provisions of §§ 403-31, 403-32 and 403-33 of this article shall be made in accordance with the provisions of Article V, Sewer Connection and Hookup Fees, of this chapter.
B. 
The installations and connections required to be made pursuant to the provisions of §§ 403-31, 403-32 and 403-33 of this article shall be made using piping materials made of extra-heavy cast iron pipe with watertight, caulked and leaded joints, at least for that portion of the lateral within the right-of-way owned, maintained or entitled to be owned or maintained by the Borough.

Present privies, cesspools or seep pits and septic tanks must be completely detached from all plumbing and must be filled in with any suitable material such as gravel, shale or excavated earth. All cesspools, pits and septic tanks must be pumped out prior to being filled. This work must be completed within 180 days after the sewer system is operative. Time extensions may be granted where hardship is proven to the satisfaction of the Borough Council. No further use of such prior system will be permitted for any purpose after sewerage is available. All hookups at the curb lateral must be inspected and approved by the Board of Health or its agents.

Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $1,250, by a term of imprisonment not exceeding 90 days or by a period of community service for not more than 90 days, or any combination thereof, in the discretion of the Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
