The Town Board finds that development related
fees may be amended between the point an applicant begins processing
a development application and the point payment of such fees is tendered.
Moreover, applicants often do not seek final signatures at the point
at which development related fees are most often paid, well after
the review process is completed. The question therefore often arises
as to the amount of the requisite fee that was in effect at the time
of processing the application or that, in effect at the time of payment,
is actually tendered. This article is intended to clarify the monetary
amount due for development fees once an applicant tenders payment.
The monetary amount due for development related
fees shall be that amount in effect at the time payment is tendered,
not that in existence at the time of review or approval.
