No person shall set up or erect a stand or booth or use any stand, booth, wagon, cart or other device upon any of the streets or public grounds in said Village for the purpose of selling or vending goods or merchandise of any kind without first obtaining a license therefor from the Village Clerk of said Village and paying the license fee hereinafter imposed.

On each stand, booth, wagon, cart or other device so erected or used, there is hereby imposed a license fee of $250 per year.

Any person violating any of the provisions contained in this article shall be liable to a fine and penalty of not less than $100 nor more than $250 or by imprisonment for not more than 15 days for each violation. Each day on which such violation continues shall constitute a separate offense.

Prior to the issuance of any license, the applicant shall deposit with the Village Treasurer the sum of $2,500 or, in lieu thereof, a bond to the Village in the amount of $2,500, which bond shall be executed by the proposed licensee as principal in a surety company licensed to do business in the State of New York, which bond shall remain in force for the term of the license to be issued and shall be conditioned as follows:
A. 
To indemnify and pay the Village for any penalties or costs incurred in the enforcement of any of the provisions of this article and to indemnify or reimburse any purchaser of personal property from the licensee in a sum equal to at least the amount of any payment such purchaser may have been induced to make through the misrepresentation as to the kind, quality or value of the personal property, whether the misrepresentations were made by the licensee or said licensee's agents, servants or employees either at the time of making the sale or through any advertisement printed or circulated with reference to such personal property or any parts thereof.
B. 
The aforesaid bond shall be declared forfeited upon proof of falsification in the application for a license.
C. 
Said bond shall be deemed forfeited upon proof of violation of any of the provisions of this article by the applicant or his agents, servants or employees.
