It shall be unlawful for any owner of any dog or other domestic animal to permit or allow such dog or other animal in the Village of Sagaponack to:
A. 
Be at large.
B. 
Disturb the comfort, peace or repose of any persons in the vicinity by long or frequent noise or odor, dust or other environmental nuisance resulting from the presence of the dog or other domestic animal.
C. 
Cause damage or destruction to property or commit a nuisance by defecating or urinating upon the premises of a person other than the owner of such dog or domestic animal.
D. 
Chase or otherwise harass any person in such a manner as reasonable to cause intimidation or to put such person in reasonable apprehension of bodily harm.
No person owning, harboring or having the control or custody of a dog shall permit such dog to:
A. 
Run at large in the Village of Sagaponack, without being muzzled, elsewhere than on the premises of such person or on the premises of another person with the consent of such other person, unless such person is engaged in hunting wild birds or animals with the aid of such dog, during open seasons, or unless such person shall take such dog afield for training in hunting.
B. 
Be at any time on any street, highway, park or public place in the Village of Sagaponack, without being muzzled, unless fully controlled by the owner or some other person by means of a rope, leash or other similar device.
C. 
Any provision herein to the contrary, notwithstanding no person owning, harboring or having the control or custody of a dog shall permit the dog on the Atlantic Ocean beach between the crest of the dune and the water's edge between 9:00 a.m. and 5:00 p.m. between May 15 and September 15.

Every female dog in heat shall be confined in a building or secure enclosure in such a manner that such female dog cannot come into contact with another animal except for planned breeding.

Any horse maintained in the Village of Sagaponack shall be so maintained as to prevent odor, insects, dust and other forms of annoyance from reaching any adjacent property, including public ways.
The person who has last obtained the issuance of a license for a dog pursuant to the provisions of the Agriculture and Markets Law, or any similar law, shall be presumed, for the purpose of this chapter, to be the owner of such dog.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes an individual, any combination of individuals or a corporation.
Any violation of this chapter shall constitute disorderly conduct, and the person violating the same shall be a disorderly person and shall be punishable and liable for a penalty not exceeding $350 for each offense.
