A. 
It shall be unlawful for any person to use spray paint or any other means of marking the property of others to injure, destroy, or in furtherance of the practice of defacing (graffiti) the property of others. For purposes of this article, the term "spray paint" shall mean any adherent, paint, varnish, lacquer, stain, or other similar solvent or substance commonly used in painting and applied by a spraying method or similar technique.
B. 
No person under the age of 18 years shall possess, buy, transfer possession, or receive possession of spray paint, except as otherwise provided herein.
C. 
Except as otherwise provided herein, no person shall sell or transfer possession of any cans of spray paint to a person under 18 years of age; provided, however, that a person may sell or transfer possession of spray paint to a person under 18 years of age for lawful uses for said individual under the age of 18 who has in his or her possession and exhibits the written consent of his or her parent or guardian.
D. 
The owner of any property defaced through the use of spray paint or other device shall remove or paint over such defaced property as soon as possible after discovery of its existence so as to preclude further vandalism or defacement of the structure or immediate surroundings.
E. 
If the individual found violating this article shall be under the age of 18 years, to the extent practical, the individual shall be required to remove the graffiti and to repaint the structure defaced or otherwise restore the premises to the condition that existed immediately prior to the defacement of said property.
F. 
A person under the age of 18 years may possess, buy, transfer possession, or receive possession of spray paint for lawful purposes when said individual has in his or her possession and exhibits the written consent of his or her parent or guardian.
Penalties for violation of this article shall be punishable as provided in Chapter 1, General Provisions, § 1-3.
