[HISTORY: Adopted by the Town Board of the
Town of Brookhaven 6-16-1987 by L.L. No. 7-1987; amended in its entirety 1-16-1990 by L.L. No.
3-1990, effective 1-19-1990. Subsequent amendments noted where applicable.]
No person shall mar, destroy or remove any flowers,
plants, shrubs, trees, buildings or structures within the Town of
Brookhaven without authority of the owner thereof.

No person shall enter, intrude or trespass upon any lot or premises
owned by or under the control of the Town Board, whether upland or
land under water, for the purpose of occupying or using the same,
or for purposes of hunting, trapping or pursuing wildlife, or of erecting,
placing or using any building, temporary or permanent structure, of
fence or other encumbrance thereon or of removing or depositing any
sand, stone, gravel, topsoil, tree, brush, shrub, or any other natural
vegetation or other minerals therefrom, without written authority
from the Town Board; but nothing herein contained shall be deemed
to prevent any resident of the Town of Brookhaven from using any Town
park or waters for ordinary bathing, boating, fishing or other public
recreational purposes.
A.
No person shall enter upon John Boyles Island, East
Island, West Island, New Made Island and Carter's Island between April
1 and August 15 of each year, except with the prior written permission
of the Director of the Brookhaven Division of Environmental Protection
or his duly authorized representative.
B.
The Division of Environmental Protection of the Town
of Brookhaven shall cause the posting of John Boyles Island, East
Island, West Island, New Made Island and Carter's Island with signs
forbidding entry upon them during the period of April 1 to August
15.

Any person violating this chapter shall be deemed guilty of
a misdemeanor and shall be punished by a fine of not less than $500
nor more than $2,000 or by imprisonment, for a period of not less
than 15 days nor more than 30 days, or by both such fine and imprisonment,
for conviction of a first offense; and by a fine of not less than
$1,000 nor more than $3,000 or by imprisonment for a period of not
less than 15 days nor more than 30 days, or by both such fine and
imprisonment, for conviction of a second or subsequent offense.
