No septic tank, leaching pit, pipe or other means for the disposal or discharge of sewage or sink wastes shall be installed anywhere in the Town of Newburgh except in accordance with all regulations of the New York State Departments of Health and Environmental Conservation and Articles XIII and XIV as herein provided. No privies shall be permitted except for temporary use in construction work upon application to the Sanitary Inspector for a temporary permit. The Sanitary Inspector will approve of the site prior to construction or placing of the privy. Reference is made to Appendix 75-A, Wastewater Treatment Standards - Individual Household Systems, of Title 10, Health, Volume 1A of the New York Codes, Rules and Regulations. In the event that the standards therein are stricter than the standards set forth below, those stricter standards shall apply. In the event that the standards herein are stricter, these stricter standards shall control.
A. 
An application and drawings are required.
B. 
Prior approval required. No work shall be commenced until the application and drawings are approved by the Sanitary Inspector, who shall endorse his approval on the application and drawings and return one so-endorsed copy thereof to the applicant.
It shall be the duty of the Sanitary Inspector:
A. 
Inspect site. To promptly inspect the proposed installation and approve or disapprove the application. If approved, the Sanitary Inspector shall so note on the original and applicant's copy and issue the applicant a colored permit (this permit shall be prominently displayed on or near the work site).
B. 
Enforcement. To see that the provisions of this Part 2 are observed.
C. 
Final inspection and approval. After final inspection, to note approval on the original and applicant's copy of the permit. The Sanitary Inspector shall inform the Town Clerk monthly of installations approved or disapproved.
No person, either as owner, lessee or tenant of any property, dwelling, building or place, shall construct or maintain any leaching pit, septic tank, sewage disposal system, pipe or drain so as to expose or discharge the contents or other liquid or matter therefrom to the atmosphere or on the surface of the ground or so as to endanger any source of drinking water, nor shall any such person discharge into any watercourse, storm drain or body of water any sewage or sewage effluent from a leaching pit, septic tank, sewage disposal system, pipe or drain except as permitted under the provisions of the Public Health Law.

Septic tanks, oil separator installations and drains and house sewers shall conform to the standards and requirements set forth from time to time in Part 75 and Appendix 75-A of the New York State Sanitary Code, as adopted or modified by the Orange County Department of Health, and in the New York State Uniform Fire Prevention and Building Code.
Nothing contained in this Article shall be construed to permit the installation or maintenance of disposal facilities which are or may become a nuisance.
