This article shall be known as the "Highway Winter Parking Law of the Town of Riga."
This article is adopted pursuant to the provisions of the Municipal Home Rule Law of the State of New York and § 1660 of the Vehicle and Traffic Law of the State of New York.
The purpose of this article is to promote the health, safety and general welfare of the community by facilitating snow removal on highways and rights-of-way during the winter months and permitting the free flow and safe passage of vehicular traffic on highways during the winter months.
The definitions contained in the Vehicle and Traffic Law of the State of New York shall apply to this article in all respects.
The parking of vehicles is hereby prohibited on all highways and highway rights-of-way, streets, roadways and shoulders in the Town of Riga from November 1 through and including April 15.
A. 
Violations of this article shall be punishable by a fine not exceeding $50 for the first offense, and for the second offense, not less than $50 nor more than $100. The third or any subsequent offense within one year may be punishable by a fine not exceeding $200 or by imprisonment not exceeding 15 days, or by both such fine and imprisonment, or by a penalty of not less than $150 nor more than $200, to be recovered by the Town of Riga in a civil action.

In addition, illegally parked vehicles are subject to being towed away, and the owner of any such vehicle shall be responsible for the payment of any towing and storage charges incurred for the removal of the vehicle, all charges to be paid prior to the release of the vehicle to the owner.
