The Town Board has regulatory jurisdiction over
the collection and disposal of all garbage and refuse generated or
accumulated within the Town of Hudson. The purpose of this article
is to regulate the collection and disposal of waste, garbage and refuse
within the Town.
As used in this article, the following terms
shall have the meanings indicated:
AUTHORIZED COLLECTOR
The person or persons specifically authorized by contract
with the Town to collect and dispose of garbage, refuse and recyclable
material.
GARBAGE
Discarded material resulting from the handling, processing,
storage, preparation, serving and consumption of food.
HOME BUSINESS
A gainful occupation conducted by members of the family within
their place of residence.
REFUSE
Combustible and noncombustible discarded material, including
but not limited to trash, rubbish, paper, wood, metal, glass, rubber,
cloth, ashes, litter and street rubbish, industrial waste, dead animals,
mine tailings, gravel pit and quarry spoils, toxic and hazardous waste
(as defined by state or federal law or administrative regulation)
and material and debris resulting from construction or demolition.
RESIDENTIAL GARBAGE OR REFUSE
All garbage or refuse generated by all housing accommodations,
specifically including all farms, single-family dwellings and two-
and three-family dwellings. "Residential garbage" does not include
waste generated by any religious, commercial or industrial operation,
establishment or business. "Residential garbage" does not include
garbage or refuse generated by a home operating a home business if
such garbage is more than 50% business-related. "Residential garbage
or refuse" does not include garbage or refuse generated by or accumulated
on multifamily dwelling premises other than duplexes and triplexes.
The authorized collector shall not collect the
garbage or refuse of a household operating a home business if the
garbage or refuse generated by the household is at least 50% business-related.
The home business shall make separate arrangements for the collection
of the garbage and refuse generated by the home business. The home
business shall notify the Town Clerk annually on or before November
30th regarding the collection arrangements that have been made.
The penalty for violating any provision of this
article shall be a forfeiture of not less than $25 nor more than $100,
plus all costs related to prosecution of the offense. Each day of
violation will be considered a separate offense.
