As used in this article, the following terms
shall have the meanings indicated:
All part of the plant Cannabis Sative L., whether growing
or not; the seeds thereof; the resin extracted from any part of the
plant; and every compound, manufacture, sale, derivative, mixture
or preparation of the plant, its seeds or resin. It does not include
the mature stalks of the plant, fiber produced from the stalks, oil
or cake made from the seeds of the plant, any compound, manufacture,
sale, derivative, mixture or preparation of the mature stalks (except
the resin extracted therefrom), fiber, oil or cake or sterilized seed
of the plant which is incapable of germination.
No person shall possess or use marijuana in
any amount, except as otherwise authorized by Chapter 961, Wis. Stats.
Any person who shall violate § 176-3 by possessing one ounce or less of marijuana shall, upon conviction, be subject to a forfeiture of not more than $500 together with costs of prosecution and penalty assessment and, in default of payment of such forfeiture and costs, shall be subject to imprisonment in the county jail until such forfeiture and costs are paid, but not to exceed 30 days.
