Any person having control or ownership of any dog shall keep said dog on a leash, cord, chain or lead, or confined within a vehicle, or confined within the real property limits of the owner or person in control of said dog, unless such dog is then being used for hunting or herding, supervised competition or exhibition, or training for any such activity and, while engaged in any such activity or training for any such activity, such dog is accompanied by its owner or custodian. For purposes of this section, the term "accompanied" means that the owner or custodian must be able to see or hear, or both, or have reasonable knowledge of where the dog is hunting or herding, or where training is being conducted or where trials are being held. Nothing herein provided shall mean that the dog must be within sight at all times.
Any owner or person having control of any dog shall not permit said dog to defecate on public property, including but not limited to public streets, alleys, sidewalks, parks, or any other public grounds within Wolfeboro, or permit said dog to defecate on any private property other than the premises of the owner or person having control of said dog, unless said defecation is removed immediately.
This article shall be enforced by any law enforcement officer and by the Animal Control Officer. A warning notice shall be issued for the first violation of this article and further violations shall subject the violator to a fine of not more than $25 for each violation.
This article shall become effective immediately upon its adoption by the Board of Selectmen.
