These regulations shall be administered by the Planning Board. The enforcement of these regulations is vested in the Board of Selectmen.
A. 
When the Planning Board finds that unusual difficulty or unnecessary hardship may result from strict compliance with these regulations, the Board may, by a majority vote of its voting members present at the meeting, vary the regulations so that substantial justice may be done. The relief of the hardship or difficulty may be granted to the developer, and public interest secured, provided such waiver will not have the effect of nullifying the spirit and intent of the Master Plan and these regulations.

B. 
In reviewing a request for a waiver, the Planning Board may consider such factors as the shape and topography of the land, innovative building design, and use of on-site materials and natural features. In granting waivers, the Planning Board may require such conditions as will, in its judgment, secure the objectives of the regulations. A request form (See Attachment 3d.[1]) and a written justification of the waivers must be submitted with the application.

Any violation of these regulations may be subject to a civil fine as provided in RSA 676:16 and 676:17, as amended. The Board of Selectmen and the Code Enforcement Officer are designated as the local authorities to institute appropriate action under the provisions of RSA 676:17.
