All sidewalks and curbs shall be constructed and paved in accordance with the standard specifications set forth in the Standard Specifications for Pavement, Sewer, Curb and Sidewalk Construction.[1]

All sidewalks shall be kept in repair, free of standing water, grass, weeds or other growths and obstructions by the owner of the abutting property. The Public Works Committee shall cause to be served upon the abutting property owner a notice, in writing, directing him/her to make such repairs. Service of said notice shall be made by personal service or by mail addressed to said property owner at his/her last known post office address, with postage prepaid, or by posting said notice on the premises affected.

A. 
Notwithstanding anything contained in §§ 259-30 and 259-32 to the contrary and subject to the provisions of § 27-3,[1] the Borough may elect, at its sole option, to replace sidewalks that are raised by the roots of a Borough tree:
(1) 
In the opinion of the Borough Engineer, at least two inches on any edge of the sidewalk slab, to the extent that funds are made available by the Mayor and Council in the annual Borough budget; and/or
(2) 
In the opinion of the Borough Engineer and the Public Works Committee, at least one inch by the roots of a Borough tree on any edge of the sidewalk slab, to the extent that funds are made available by the Mayor and Council in the annual Borough budget and to the extent that the Public Works Committee deems the condition of the sidewalk caused by the root(s) to be unsafe.

B. 
Replacement of the sidewalk shall include lifting the sidewalk, having the tree trimmed where necessary at the determination and direction of the Shade Tree Commission, having the tree roots cut at the determination and direction of the Shade Tree Commission and replacing the sidewalk.
If the owner of the property upon whom a notice to repair has been served, as provided in the preceding section, shall fail, neglect or refuse to make the repairs in compliance with said notice and within 30 days after notification, the Public Works Committee may make such repairs. The costs thereof, with interest, shall be assessed as a tax upon the abutting property and shall be a lien thereon and collected as other legal assessments and taxes are collected.
