As used in this chapter, the following terms shall have the meanings indicated:
BERM
A quantity of dirt, stone, fill or other material, or combinations of material, which is mounded up by a property owner.
Unless a building permit has been issued, no berm shall be constructed in the Village which is more than two feet above natural grade at all points.
No fence shall be erected on a berm governed by this chapter.
The berm shall be landscaped on all sides with ground cover approved by the Building Inspector, and it shall be maintained in a neat and clean manner on all sides by the property owner.
The toe of the slope of all berms shall be located at least six feet from the property line.
Any violation of this chapter shall be punishable by injunction or a fine not less than $300 and not more than $500 per day, provided that a separate accusatory instrument is issued for each violation (i.e., each day).
