No one shall consume an alcoholic beverage or have an open or unsealed container of an alcoholic beverage in a public place.
As used in this chapter, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Includes beer, ale, wine and other drink containing alcohol.
CONTAINER
Anything capable of holding an alcoholic beverage, whether it is the bottle or can in which the beverage was originally marketed or a bag or other carrying device.
PUBLIC PLACE
A park, beach, street, parking area or other property in the village owned by the village, a town, Suffolk County or the State of New York.
A. 
A person who is in a motor vehicle or other conveyance which is in a public place is deemed to be in a public place.
B. 
An alcoholic beverage in an open or unsealed container in a motor vehicle or other conveyance in a public place is deemed to be in the possession of all the occupants of the motor vehicle or other conveyance.
This chapter does not apply to persons who consume or possess an alcoholic beverage in a public place if a license or permit has been obtained in advance under laws or regulations of the village or the State of New York.
A person who violates this chapter may be subject to a fine of up to one hundred fifty dollars ($150.) and imprisonment for up to ten (10) days in jail for a first offense and a fine of up to five hundred dollars ($500.) and imprisonment for up to thirty (30) days for a second offense.
