Any person operating a vehicle holding any material extending over either
end of such vehicle shall maintain at the end of such material a red flag
during the day and a red light, visible for 300 feet, during the period from
one hour after sunset until one hour before sunrise.
It shall be unlawful to operate or cause to be operated a motor vehicle,
trailer or semi-trailer having a gross weight, including chassis, body and
load, in excess of 20,000 pounds over and upon any hard-surfaced road under
the jurisdiction of the Township within the physical boundaries of the Township,
except as hereinafter set forth:
A. Under certain conditions and circumstances the Chief
of Police may issue a special hauling permit to enable motor vehicles having
a gross weight in excess of 20,000 pounds to be operated upon hard-surfaced
roads under the jurisdiction of and within the physical boundaries of the
Township. The said permit shall expire 30 days after issuance unless revoked
sooner pursuant to the authority set forth in other sections of the ordinances
of the Township. However, the Chief of Police is hereby vested with the authority
to extend the aforesaid thirty-day period if in his discretion he determines
that the circumstances attendant to the hauling project justify an extension
of time. The factors that may be taken into account include, but are not limited
to, the following: weather conditions; size of the project; reasonable time
periods for completion of the project and the diligence of the permit holder
in completion of the project for which hauling is necessary.

jurisdiction of and within the physical boundaries of the Township must apply
to the police of Kilbuck Township for a special hauling permit upon a form
prepared by the Township; and if any combined job weight is in excess of 100,000

guaranteeing Township that applicant shall and will, upon notice from Township,
repair or pay for any damage to any road damaged by applicant as a result
of the operation of a motor vehicle by applicant.
C. Each application must be accompanied by a special hauling
permit fee in an amount as set from time to time by resolution of the Board
of Supervisors. In addition, if a bond is required to be posted, the application
must be accompanied by the cost or fee charged to the Township by its professional
engineer for work attendant to the bonding analysis, said cost or fee to be
fair and reasonable and is intended only to reimburse the Township for its
actual costs associated with the processing of the application.
[Amended 9-19-1995 by Ord. No. 50]
D. The police may revoke the special hauling permit at any
time.
E. No person, firm or corporation shall operate a tractor
upon the highways of the Township in such a manner as to cause extraordinary
damage to the roadway when the roads are soft because of weather conditions.
F. Littering of roadways.
(1) No person, firm or corporation shall drive or move any truck
or other vehicle within the Township unless such vehicle is so constructed
or loaded as to prevent any load, contents or litter from being blown or deposited
upon any street or road in the Township.
(2) No person, firm or corporation shall drive or move any
truck or other vehicle within the Township, the wheels of which carry onto
or deposit on any street or road in the Township mud, dirt, sticky substances,
litter or foreign matter of any kind.
(3) If, in the course of excavation, building or construction
or development of any property, any mud or dirt or any other foreign substance
is unavoidably carried onto any street or road in the Township, it shall be
the duty of the property owner and/or contractor having supervision over the
job to remove the same at the end of each workday, so as to make the street
or road clean and safe for the passage of normal vehicular traffic.
