This chapter shall apply to the administration
of construction, repair, alteration and removal of all buildings and
structures in the Village of Lynbrook, the organization and management
of the Building Department, the issuance of building permits and performance
and inspection of work thereunder, the revocation of permits and stop-work
orders, the issuance of certificates of occupancy, fire prevention,
violations, the issuance of summonses and appearance tickets, the
abatement of violations, penalties for offenses and other matters
affecting administration and fire prevention.
The provisions of this chapter are remedial
and shall be construed liberally to secure the beneficial interests
and purposes thereof, which are the protection of public safety, health
and welfare in relation to the construction, alteration, repair, removal,
demolition and occupancy and maintenance of buildings and structures
in the Village of Lynbrook.
As used in this chapter, the following terms
shall have the meanings indicated:
ALTERATION
As applied to a building or structure, the change or rearrangement
of the structural parts, partition walls, or any enlargement, whether
by extending on any side or increasing the height or depth thereof
or by moving same from one location to another, but shall not include
ordinary repairs to buildings or structures.
LAW
Includes the Uniform Code and any other law of the State
of New York or local law, ordinance, rule or regulation of this village,
pertaining to structures or the use or occupancy thereof.
STRUCTURE
Any combination of materials arranged to form a construction
that is intended to be stable, durable and functional, including,
without limitation, for purpose of illustration, a building, platform,
booth, shed, storage bin, kiosk, wall, bridge, trestle, arch, viaduct,
fountain, pool, buttress, vault or fence. The term "structure" shall
be construed as if followed by the words "or part thereof."
SUPERINTENDENT
The Superintendent or other person in charge of the Building
Department of the village, or a duly authorized representative.
UNIFORM CODE
The New York State Fire Prevention and Building Code, as
amended from time to time.
