A. 
The plumbing and draining systems, water supply pipes, gas piping, steam or hot-water heating or power systems, refrigerating systems and other systems of pipes or apparatus for holding or conveying gases, vapors or fluids currently maintained or hereinafter installed in or upon any building in the Village shall conform to such rules as may be provided for by law or may be found necessary for the protection of life, health or property and adopted by the Superintendent of Buildings. No person shall use or permit the use of any system, piping or apparatus installed or maintained in violation of any of the provisions of this chapter or the rules adopted hereunder.

B. 
Nothing herein contained or in the rules adopted hereunder shall require the alteration or reconstruction of any existing work that was lawfully installed nor prevent repairs or the addition of new fixtures to existing work in conformity with the practice followed in the original installation; provided, however, that if such repairs involve the removal or alteration of more than 1/2 of the existing work affected by the repairs, the rules in force at the time of such repairs shall apply.
C. 
Adoption of the New York State Uniform Fire Prevention and Building Code Plumbing Code.
(1) 
A certain document, three copies of which are on file in the office of the Village Clerk of the Incorporated Village of Lynbrook, Nassau County, New York, being marked and designated as the "New York State Uniform Fire Prevention and Building Code" (9 NYCRR Subtitle S Chapter 1) as amended from time to time, be and is hereby adopted as the Plumbing Code of the Incorporated Village of Lynbrook, Nassau County, New York, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Plumbing Code are hereby referred to, adopted and made a part hereof, as if fully set forth in this subsection, with the additions, insertions and changes, if any, prescribed in Subsection C(3) of this section.
(2) 
Inconsistent local laws and ordinances repealed. That all local laws and ordinances or parts of local laws and ordinances in conflict herewith are hereby repealed.
(3) 
Additions, insertions and changes. All additions, insertions or changes to the New York State Uniform Fire Prevention and Building Code Plumbing Code are on file in the Village Clerk's office and are available for inspection during normal business hours.
(4) 
Saving clause. Nothing in this subsection or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing, under any act or local law hereby repealed as cited in Subsection C(2) of this section, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this subsection.
Every building hereafter erected and also every existing building, other than residence buildings occupied exclusively by one or two families and having not more than 15 sleeping rooms, which may be supplied from some outside source with gas, vapor or fluid, except potable waters, shall have a conveniently accessible stopcock or other suitable device fixed to the supply pipes leading into the building at a place outside of the building, so arranged as to allow the supply to be shut off. Such stopcock or other device shall be so marked as to indicate the contents and purposes of the supply pipe to which it is attached or the company to which the device belongs.

No person shall maintain or use or permit the use of any system of plumbing and drainage installed in any building unless same has been tested under the supervision of the Building Department and in accordance with its rules to ensure the tightness of the system nor until a proper and adequate water supply has been provided. The Superintendent of Buildings shall, within a reasonable time after being requested to do so, cause to be inspected and tested any system of plumbing and drainage that is ready for such inspection and test and, if the work is found satisfactory and the test requirements are complied with, shall issue a certificate to that effect. Nothing herein contained shall prevent the inspection and test of part of a system or the issuance of a partial certificate nor prevent the use of such part of a larger system, provided that such part constitutes by itself a complete system properly tested and supplied with water.

No person shall maintain or use or permit the use of any system or an extension of a system of gas piping in any building unless same has been inspected and tested under the supervision of the Building Department and in accordance with its rules to ensure the tightness of the system. The Superintendent of Buildings shall, within a reasonable time after being requested to do so, cause to be inspected and tested any system of gas piping that is ready for such inspection and test, and, if the work is found satisfactory and the test requirements are complied with, he shall issue a certificate to that effect.

A. 
Appointment; purposes. The Board of Trustees shall appoint an Examining Board of Plumbers of four members plus the Superintendent of the Department of Buildings. Each member shall serve for four years concluding on the first Monday in April of the last year of that member's term. The appointments shall be made so that one member's term shall expire at the end of each successive year. The Board shall have the power to determine the qualifications and fitness of applicants for licenses, to recommend to the Board of Trustees, for good cause shown, the suspension or revocation of any license issued and to act with respect to other matters requiring their determination provided for in this chapter.
B. 
Compensation of members. The members of the Examining Board of Plumbers shall be compensated in such amount as set by resolution of the Board of Trustees.
C. 
Vacancies. The Board of Trustees shall have the power to remove any member of the Examining Board of Plumbers and to fill any vacancy therein.
D. 
Organization. The Examining Board of Plumbers shall consist of four members plus the Superintendent of the Department of Buildings, who shall act as Chairman. All members shall be master plumbers who have been master plumbers for a period of not less than five years. A majority of the Board shall elect a Secretary.
E. 
Quorum. Two members plus the Superintendent of the Department of Buildings, who shall be entitled to vote, shall constitute a quorum of the Board for the transaction of business.
F. 
Meetings. The Board shall meet on the call of the Chairman or on the call of the Village Board.
G. 
Alternate members. The Village Board shall appoint a first alternate member and a second alternate member who shall be called to serve on the Examining Board of Plumbers as a temporary replacement for any Board member who may be unavailable to serve in such situations as recusal, sickness, vacation, business engagements or the like. The Chairman shall initially call the first alternate to serve and, upon the unavailability of the first alternate to serve, shall call upon the second alternate to serve.

A. 
Once in each year, every employing or master plumber carrying on his trade, business or calling in the Village shall register his name and address at the office of the Building Department in said Village under such rules as said Department may prescribe. Such registration may be canceled by the Village Board for a violation of the rules and regulations for plumbing or drainage of such Village duly adopted or in force pursuant to the provisions of this chapter or whenever the person so registered ceases to hold a certificate from the Examining Board of Plumbers or to be actually engaged in the business of master or employing plumber, after a hearing before said Superintendent, upon prior notice of not less than 10 days.
B. 
No person shall install, alter or repair or cause to be installed, altered or repaired any plumbing installation within the Village, except a person holding a plumber's license as a registered plumber issued by the Village or by a plumber as provided in Subsection H of this section. A corporation may install, alter or repair, or cause to be installed or repaired, any plumbing installation, provided that such work is done pursuant to the direction and supervision of an officer of such corporation duly licensed and registered as a plumber pursuant to this chapter or as provided by Subsection H of this section.
C. 
This chapter shall not apply to any employee of the federal government doing government work or of the State of New York or of any political subdivision thereof when employed on the business of the State of New York, nor shall this chapter apply to any owner of premises or the tenant thereof when doing work in washers, cleaning traps, fixing leaks in the hot or cold waterline or in the hot-water tank or replacing defective parts in toilet tanks or such other minor repairs as shall not affect the health of persons in said premises or of people residing in the neighborhood.
D. 
It shall be unlawful for any person in the village to engage in or carry on the trade, business or calling of employing or master plumber, unless such person has conspicuously posted in the window of the place where such business is conducted a metal plate or sign appropriately lettered or marked LICENSED PLUMBER, in accordance with rules adopted by the Superintendent of Buildings.
E. 
No person registered as provided in this section or who holds a certificate from the Examining Board of Plumbers shall, for the benefit of any person engaged in the plumbing business who is not so registered, apply for, receive or make use of any permit granted to him by reason of being so registered or holding such certificate from the Examining Board of Plumbers.
F. 
Installation of a house sewer and the lateral connection with the public sewer shall be considered plumbing work and shall require a permit issued to a licensed plumber as provided in this section. The permit fee therefor shall be in such sum as set by resolution of the Board of Trustees.

G. 
A fee for a permit to connect or disconnect a dwelling to or with the public sewer shall be paid to the village in such sum as set by resolution of the Board of Trustees.

H. 
All persons hereafter applying for a license as plumber in the village must pass an examination before the Village Examining Board of Plumbers as to their practical and theoretical knowledge of plumbing and the rules of such Examining Board and the plumbing rules of said village and shall pay a fee in such sum as set by resolution of the Board of Trustees to cover the cost of such examination, license fee and license plate, except that a certificate or license issued by a municipality in the County of Nassau will entitle the holder thereof to a license from the village and to work in said village without examination, provided that he pays an application fee in such sum as set by resolution of the Board of Trustees and presents for inspection with his application the license which has been issued to him by such other municipality, and provided further that the municipality issuing such license has, by resolution or other legal provision, agreed to issue licenses to the residents of the village upon like terms and conditions.
I. 
License and inspection fees.

(1) 
Licenses issued by the village as hereinabove provided shall be for a period of two years and shall expire on January 31 of each even-numbered year and may be renewed upon payment of such fee as set by resolution of the Board of Trustees.

(2) 
Inspections shall be made by the Superintendent of Buildings or by a person designated to make such inspections; the fees therefor shall be set by resolution of the Village Board.

J. 
A fee in an amount set by resolution of the Board of Trustees will be charged for the examination or test of each applicant, which will cover the cost of each such examination or test by the Examining Board of Plumbers.

L. 
Notwithstanding anything to the contrary contained in this chapter, any applicant for a certificate of competency from the Examining Board of Plumbers from the Village of Lynbrook who maintains his principal place of business within the County of Nassau and who holds a currently valid certificate of competency and/or a master plumber's license duly issued after examination by the Town of Hempstead, the Town of North Hempstead or the Town of Oyster Bay or any other municipality within the County of Nassau which is a party to the said reciprocal agreement for the licensing of master plumbers, entered into, by and between the Towns of Hempstead, North Hempstead and Oyster Bay on date September 15, 1969, shall, without further examination or fee, be entitled to the same rights and privileges as are granted to one who has obtained a Village of Lynbrook master plumber's license or certificate of competency under this chapter; provided, however, that such applicant shall submit, together with his application, a certificate of competency and/or a certified copy of a currently valid master plumber's license.

M. 
The fee for issuance of a license to a master plumber who has obtained a certificate of competency shall be in an amount set by resolution of the Board of Trustees and shall be renewable biannually at a fee in an amount set by resolution by the Board of Trustees.

A. 
Drawings and triplicate descriptions, on forms furnished by the Department of Buildings for all plumbing drainage, shall be properly filled in and filed by the owner or architect in said Department. The plans must be drawn to scale in ink on paper or they must be cloth prints of such scale drawings and shall consist of such floor plans and sections as may be necessary to show clearly all plumbing work to be done and must show partitions and methods of ventilating water closet apartments.
B. 
Plumbing and drainage work shall not be commenced or proceeded with until said drawings and descriptions shall have been so filed and approved by the Superintendent of Buildings.
C. 
No modification of the approved drawings and descriptions will be permitted, unless either amended drawings and triplicate descriptions or an amendment to the original drawings and descriptions covering proposed change or changes are so filed and approved by the Superintendent of Buildings.
D. 
The drainage and plumbing of all buildings, both public and private, shall be executed in accordance with the rules and regulations as hereinbefore stated.
E. 
Repairs or alterations of plumbing or drainage may be made without filing drawings and descriptions in the Department of Buildings, but such repairs or alterations shall not be construed to include cases where new vertical lines or horizontal branches of soil, waste, vent or leader pipes are proposed to be used.
F. 
Notice of such repairs or alterations shall be given to the Department of Buildings before same are commenced in such cases as shall be prescribed by the rules and regulations as hereinbefore mentioned, and the work shall be done in accordance with said rules and regulations.
G. 
Where repairs or alterations, ordered by the Board of Health or for sanitary reasons, include cases where new vertical and horizontal lines of soil, waste, vent or leader pipes are proposed to be used or old ones replaced, drawings and descriptions must be filed with and approved by the Superintendent of Buildings before same shall be commenced or proceeded with.
H. 
Repairs and alterations may comply in all respects with the weight, quality, arrangements and venting of the rest of the work in the building, except that when an existing soil, waste or vent line has been damaged by fire or other cause to the extent of 50% or more of its entire length, same must be replaced by new lines installed in accordance with the rules and regulations governing new lines.
I. 
No plumbing and drainage or any part thereof shall be commenced until the plumber who is to do the work shall sign the specifications and make affidavit that he is duly authorized to proceed with the work. The affidavit must give the name and address of owner and plumber, etc. No registered plumber shall sign the specifications and act as the agent for a plumber who has not obtained a certificate of competency from the Examining Board of Plumbers as an employing or master plumber. A violation of this rule will be deemed a sufficient reason by the Superintendent of Buildings for the cancellation of a certificate of registration.
J. 
One set of specifications will be received for not more than 10 houses and then only when on adjoining lots and the houses are exactly alike.
K. 
Written notices must be given to the Superintendent of Buildings by the plumber when any work is begun and at such times as the work is ready for inspection.

The provisions of Chapter 81 hereof relating to inspections (§ 81-16), enforcement (§ 81-17) and remedies for offenses (§ 81-18) are applicable in all respects to this chapter.[1]
