[HISTORY: Adopted by the Mayor and Council of the Borough of Dunellen 9-6-1967. Amendments noted where applicable.]
Where it shall be necessary and expedient for the preservation of general public safety, it shall be the duty of every owner of lands lying within the limits of the Borough of Dunellen to keep all brush, hedges and other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways cut to a maximum height of three feet when measured from the existing height of the roadway at its center, except when such plant life is reposed on land at a higher elevation above the roadway, in which case the overall height, including the earth embankment and the plant life, shall not exceed three feet, when measured in the aforementioned manner, within 15 days after written notice to cut the same. Said notice shall be forwarded by the Police Department to the last known address of the owner.
A.
In the event of the failure of such owner to comply with the provisions of this chapter, as set forth in § 114-1, the Superintendent of Public Streets or his authorized agent may cut the brush, hedges or other plant life within 10 feet of a roadway and 25 feet of the intersection of two roadways to the specified limits, and shall charge the cost of said cutting against the lands. The said cost shall be certified to the Borough Council and, if found to be correct, shall be assessed against the lands except that, should this cost be excessive, the Council shall assess a reasonable cost which will be charged to the lands.
B.
All charges and costs so accrued shall forthwith become a lien upon such lands and shall be added to and become a part of the taxes next to be assessed and levied against such lands. The same shall bear interest at the same rate as other taxes and shall be collected and enforced by the same officer and in the same manner as taxes.
Any person who shall refuse or neglect, after written notice as above set forth, to comply with the demands set forth in this chapter with respect to the cutting of the brush, hedges and other plant life in the interest of public safety shall, upon conviction, be liable to a penalty not exceeding $500 or imprisonment to a term not exceeding 90 days, or both. Each and every day in which said owner shall refuse or neglect to comply with this chapter shall constitute a separate offense.
