The Planning Board shall have the discretionary power to vary any maximum numerical limitation on signs in this chapter by 15%, provided that such a variation does not detract from the purpose of this chapter. Such variation shall require the vote of a majority plus one.
A. 
Sign permit applications with accompanying material will be received by the Enforcement Official and reviewed as per provisions of § 133-38.
B. 
All decisions shall be transmitted in writing and copies sent to applicant, the Enforcement Official and involved boards and committees.

A. 
The provisions of this chapter shall be administered and enforced by the Enforcement Official, who shall have the power to make any necessary inspections.
B. 
No sign permit shall be approved by the Enforcement Official except in compliance with the provisions of this chapter or as directed by the Zoning Board of Appeals under the provisions of Article XIV of Chapter 174, Zoning.
A. 
Except as otherwise provided herein, after the effective date of this chapter, no sign shall be erected, moved or altered, except as required by Article IX unless and until a sign permit for such work has been obtained.
B. 
No permit is required for the following:
(1) 
Exempt signs.
(2) 
A sign to be repaired in exact duplication of the original.
C. 
Application for the sign permit, on forms provided by the Village Clerk, shall be submitted to the Enforcement Official.
D. 
Applications shall contain or have attached thereto the following information and material:
(1) 
A fee as established by the Board of Trustees.
(2) 
Information listed on the application form.
(3) 
Drawing at an appropriate scale, as necessary to show the design, dimensions and colors of the graphics and sign structure, details of any illumination sources and placement of the sign relative to the building or structure on which it is located and/or in relation to nearby buildings, structures, street lines and property lines.
(4) 
In the case of existing buildings, the drawing may be an overlay of a photograph of the building having as little oblique distortion as possible.
(5) 
Such other information as the Enforcement Official may reasonably require to determine full compliance with this and other laws, ordinances and regulations.
E. 
Action upon receipt of application.
(1) 
Within seven days of receipt of the complete application, the Enforcement Official shall:
(a) 
Approve the application as clearly meeting the requirements of this law; or
(b) 
Transmit one copy and accompanying material to the Planning Board, which shall make its recommendations and/or decisions within 30 days.
(2) 
If the proposed sign is in conformance with all requirements, as in Subsection E(1)(a), the Enforcement Official shall issue a permit within seven days.
F. 
If a sign authorized by a permit is not completed and in place within six months, said permit shall become null and void.
G. 
Design, construction and placement of a sign shall not deviate in any substantial manner from the plans approved for issuance of the permit.
A. 
In accordance with the provisions of Article XIV of Chapter 174, Zoning, the Board of Appeals shall hear and decide on the following appeals:
(1) 
Questions of alleged error in any order or determination of the Enforcement Official involving the interpretation of the provisions of this chapter.
(2) 
Request for a variance from the provisions of this chapter.
B. 
No Board of Appeals decision shall be made in a variance until an advisory opinion is received from the Planning Board. Failure of said Board to report an opinion prior to the hearing on the appeal shall be construed as approval of the variance.
C. 
Any person aggrieved by a decision of the Board of Appeals may have the decision reviewed by the State Supreme Court in the manner provided by law.
A. 
In the event of violation of any of the provisions of this chapter, the Enforcement Official shall notify the owner of the premises in writing to remove, repair or make the sign in conformance within 30 days of the date of such notice.
B. 
Any person who violates any provision of this chapter shall, upon conviction thereof, be punishable by the penalties set forth in Chapter 1, General Provisions, Article II.
C. 
Each day that such violation is permitted to exist shall constitute a separate violation.
D. 
If any sign is erected, altered or moved in violation of the provisions of this chapter, proper officials may, in addition to other remedies, institute an appropriate action to prevent such unlawful operation.
E. 
Upon failure to comply with any notice within the prescribed time, the Enforcement Official shall remove or cause removal, repair or conformance of a sign and shall assess all costs and expenses incurred against the owner of the building or land on which the sign is located.
