§ 13-1 Definitions and word usage.

A. 
The following definitions shall apply in the interpretation and the enforcement of this chapter:
BOARD OF HEALTH
The Board of Health of the Borough of Boyertown as appointed by the Borough Council of the Borough of Boyertown.
B. 
Wherever appropriate, words used in this chapter in the singular may include the plural or the plural may be read as the singular; and the masculine may include the feminine.

§ 13-2 Authority.

A. 
The administration of the health regulations of the Borough of Boyertown shall be enforced by the Board of Health or its duly authorized representative, which shall have the powers and duties to enforce the laws of the Commonwealth of Pennsylvania, the regulations of the State Department of Health, all ordinances of the Borough of Boyertown enacted to prevent the introduction and spread of infectious or contagious diseases, and any and all public health-related rules and regulations now or hereafter adopted by and enacted and ordained by the Borough Council of Boyertown; to abate and remove all nuisances which the Board of Health shall deem prejudicial to the public health; to mark infected houses or places; and to recommend all such other rules and regulations as shall be deemed necessary for the preservation of the public health. Any recommended rules and regulations shall not become effective until they have been approved by the Borough Council and enacted as ordinances of the Borough of Boyertown. The Board of Health shall also have the power, with the consent of Borough Council, in case of a prevalence of any contagious or infectious disease, to establish one or more emergency hospitals, and to make provisions and regulations for the maintenance and management of the same.
B. 
The Board of Health shall also have the power to recommend to Borough Council all necessary rules and regulations not inconsistent with law, for carrying into effect the powers and functions with which the Board of Health is invested by law, and the power and authority relating to the public health conferred on boroughs. Such rules and regulations shall not become effective until they have been approved by the Borough Council and enacted as ordinances of the Borough of Boyertown.
