Spring Garden Township ("Township") generally does not permit
the use of sewage grinder and ejector pumps (hereinafter referred
to as "pumps"). All requests for waivers shall include a written justification
from the property owner or its designated representative. All requests
shall include pump design, material and installation specifications,
including a wiring diagram and site work layout. All requests shall
be submitted for review and approval by the Township and its Engineer.
Wherever gravity service is reasonably available, the use of
pumps as the sole means of providing sanitary sewer service shall
not be permitted. Supplemental use of pumps (for instance, to provide
basement service) would, however, be acceptable upon approval by the
Township.
Installation of pressure sewers in public streets, crossing
property lines, is to be avoided, and installation serving two or
more parties is to be avoided. Where a private easement is necessary,
all agreements shall be submitted for review and approval by the Township,
its Engineer, and its Solicitor.
The property owner shall be fully responsible for the maintenance,
repair and replacement of the pump located on the owner's private
property. Maintenance: Township to require formal agreement making
the owner responsible for the maintenance, including bond or other
financial guarantee.
Emergency replacement may be made upon providing to the Township
written notification of such replacement. At the time of notification,
pump type, make and model information is to be provided to Township.
Pumps are to be used solely for the conveyance of sanitary waste.
Drainage from roof, foundation, surface or other storm drainage shall
not be permitted to pass through the pump.
The property owner/developer shall be required to sign a waiver
of Township liability, to be provided by the Township and recorded
by the Township's Solicitor.
The owner/developer shall be responsible for the costs incurred
for review by the Township's Engineer and the legal costs, such as
the recording of the waiver of Township liability, by its Solicitor.
After Township approval of the installation of a pump, the owner/developer
shall obtain a pump permit from the Township. A nonrefundable permit
fee shall be established by the Spring Garden Township Board of Commissioners,
by resolution as may be adopted from time to time, and shall be paid
at the time of application for the pump.
Any pumps installed prior to this part shall be subject to the
rules and regulations at the time of its installation as long as they
do not require replacement.
Any person who violates any of the provisions of this part shall,
upon conviction thereof in a summary proceeding, be sentenced to pay
a fine of not more than $1,000. Each day that said violation continues
shall be deemed to be a separate offense.
