A. 
A certain document, one (1) copy of which are on file in the office of the City Clerk of the City of Battlefield, Missouri, being marked and designated as the International Residential Code for One- and Two -Family Dwellings, 2018 Edition, including Appendix Chapters A, B, C, D, G, H, J, M, N, and P, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Battlefield, in the State of Missouri, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code on file in the office of the City Clerk are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Subsections (B) and (C) of this Section.
B. 
The following sections are hereby revised:
1. 
Section R101.1 Title. Insert into bracketed area: "City of Battlefield, Missouri."
2. 
Section R113.4 Violation penalties. Add a sentence to the end of the paragraph to read as follows: "The penalties are set forth in Section 500.120 of the Code of Ordinances of the City of Battlefield, Missouri."
3.

C. 
Based on Missouri State Law Chapter 67, Section 67.281, RSMo., "Installation of fire sprinklers to be offered to purchaser by builder of certain dwellings — purchaser may decline," the following sections are modified unless the purchaser of the dwelling opts to install a fire sprinkler system:
1. 
Section R309.5 Fire sprinklers. Delete in its entirety.
2. 
Section R313 Automatic fire sprinkler systems. Delete in its entirety and substitute the following language: "A builder of five (5) or more connected units shall comply with the design and installation requirements of the 2018 International Residential Code for One- and Two-Family Dwellings, Section P2904. The builder of four (4) or less connected units shall comply with the fire-suppressant separation as provided in Section R317 of the 2006 International Residential Code for One- and Two-Family Dwellings or Section P2904 of the 2012 International Residential Code for One- and Two-Family Dwellings at the builder or purchaser's costs and option."
3. 
Section P2904 Dwelling unit fire sprinkler systems. Delete in its entirety.
D. 
Nothing in this Article or in the Residential Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance repealed by Ordinance No. 19-11; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

Any person violating any of the provisions of this Article or the Code adopted in this Article shall be deemed guilty of an ordinance violation and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment, or punished as otherwise permitted under the Statutes of the State of Missouri. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
