The office of Marshal is hereby abolished. The duties of the Marshal are hereby assumed by the Chief of Police who shall be appointed as provided in Section 115.291.

The Chief of Police shall be recommended by the City Administrator and appointed by the Mayor. Such appointment shall be approved by a majority of the Board of Aldermen. The Chief of Police shall hold office for an indefinite term.

A. 
The Chief of Police must meet the following qualifications:
1. 
Residence requirement. Must live within fifteen (15) minutes travel time of the City Hall of the City of Carl Junction within one (1) year after appointment.
2. 
Education. Must be specialized in Police administration, criminology-related subjects or its equivalent in professional experience.
3. 
Professional experience. Must have served in Police service a minimum of four (4) years and long enough to possess a high degree of technical competence in investigative work, law enforcement and patrol; must have served in a supervisory and administrative capacity for a minimum of four (4) years and long enough to possess a working knowledge of the principles of administration and supervision.
4. 
Knowledge, abilities and skills.
a. 
Knowledge of and the ability to effectively apply the principles of Police administration, personnel management and supervision.
b. 
Ability to plan, direct and coordinate the work of others.
c. 
Knowledge of the standards by which the quality of Police service is evaluated.
d. 
Ability to interpret statistical data in terms of its significance and identify areas of needed action.
e. 
Ability establish and maintain effective working relationships with other City Officials, State and Federal authorities, civic leaders and the general public.
f. 
Ability to provide effective leadership for and maintain harmonious relationships with personnel in the department.
g. 
Ability to prepare and present effectively oral and written informational material relating to the activities of the Police Department.
h. 
Ability to analyze situations accurately and to adopt an effective course of action.
i. 
Ability to plan, prepare and execute a proposed budget.
5. 
Personal characteristics. Good health and free from disabilities which would prevent the Chief from fulfilling his/her duties and responsibilities, a satisfactory record as a responsible, law-abiding citizen, reliability, integrity, progressive attitude, pleasing personality, neat personal appearance.

The position of Chief of Police shall be an administrative and ministerial position where the employee consults with the City Administrator and the Mayor in determining plans and policies to be observed in the conduct of Police operations. The Chief of Police is the chief executive of the Carl Junction Police Department and as such is responsible for the administration of the department. He/she is administratively responsible to the City Administrator and the Mayor for the suppression of crime, protection of life and property, the preservation of law and order, the enforcement of the criminal laws of the State of Missouri and the laws and ordinances of the City of Carl Junction and the detection and apprehension of offenders.

Prior to entering upon the discharge of his/her duties, the Chief of Police shall enter into a good and sufficient surety bond in the sum of one million dollars ($1,000,000.00) payable to the City of Carl Junction and be conditioned upon the faithful performance of the duties of his/her office. Said bond shall be from the budget of the Department.

A. 
The Police Chief shall be responsible for all resources, manpower, material, equipment, money assigned to the department and their efficient and economical utilization toward the accomplishment of the Police mission.
B. 
The Police Chief shall be responsible for planning and executing the programs designed to suppress crime and accidents, detect and apprehend criminal and traffic offenders and protect and recover property.
C. 
The Police Chief shall be responsible for the discipline, safety, conduct, work performance, assignment, promotion and demotion of all employees of the department.
D. 
The Police Chief shall be responsible for the preparation and execution of a proposed department budget and administration of the fiscal affairs of the department in a manner calculated to convert available resources into maximum effective Police service with the highest degree of economy. Such responsibility shall be within guidelines established by the Mayor and the Board of Aldermen. Departmental budgeting information and procedures shall be prepared and conducted in accordance with the guidelines established by the Mayor with final budget authority and approval coming from the Mayor and Board of Aldermen. Departmental expenditures shall be made in accordance with the purchasing guidelines established by the Mayor and Board of Aldermen.
E. 
The Police Chief shall be responsible for and have the authority to formulate, promulgate and enforce department policies, procedures, regulations, personnel and equipment specifications, not inconsistent with the laws or ordinances of the Missouri State Statutes and Federal laws as they apply and subject to the approval of the Mayor and the Board of Aldermen.
F. 
The Police Chief shall be responsible for and see that all Police Department personnel receive the necessary training to enable them to effectively and efficiently perform their job duties and responsibilities within budgetary limits set by the Mayor and Board of Aldermen.
G. 
The Police Chief or his/her designated representative shall attend upon the Municipal Court during the sittings of such court, preserve order therein and execute such orders and process as may be given or directed to him/her by the court.
H. 
The Police Chief or his/her designated representative shall attend all meetings of the Board of Aldermen, preserve order therein and execute such orders and process as may be given or directed to him/her by the Mayor or, in the absence of the Mayor, the President of the Board of Aldermen.

The salary of the Chief of Police shall be such as from time to time the Board of Aldermen shall fix as a certain amount per month payable by warrant on the City Treasury.
