When the Board shall deem it necessary to improve any public
way within the limits of the City, including curbing, when in the
street beyond the sidewalk, or any part thereof, for which a special
tax in excess of sixty cents ($.60) per front foot per annum is to
be levied, the Board shall, by resolution, declare such work or improvement
necessary to be done.

The Board shall cause such resolution to be published in some
newspaper published in the City, and the publication shall run for
seven (7) consecutive insertions in a daily paper or for two (2) consecutive
insertions in a weekly paper.

All owners of property to be charged with the special tax for
the improvement, who shall be residents of the City at the time of
the passage of the resolution, may, within ten (10) days after the
date of the last insertion of the publication, file their written
protest against the making of the improvement with the City Clerk.

If a majority of the qualified property owners do not, within
the time specified in the preceding Section, protest the making of
the improvement, the Board may proceed with the making of the improvement,
and enter into contracts therefor; and the finding of the Board that
a majority of the resident property owners did not file protests against
the improvement shall be final and conclusive.

If a majority of the resident property owners do not protest the making of the improvement, the Board shall cause the proper officer of the City to make an estimate of the cost of the improvement, prepare plans and specifications therefor, advertise for bids, and let a contract for improvement, all as provided in Article
I.

All improvements made in compliance with the provisions of this Article shall be paid by a special assessment and special tax bills, apportioned in accordance with the provisions of Section
535.290 of this Article unless the proceedings of the Board expressly specify that the cost is to be paid from the General Funds of the City.
