This chapter shall be known as the "Educational Service Agency Ordinance."
There is hereby established, pursuant to the Act of the General Assembly No. 108 of 1979, as amended,[1] an agency to be known as the "Educational Service Agency," effective January 1, 2009, for the purpose of employing school crossing guards and other employees as may be deemed appropriate by Council.

The Educational Service Agency shall consist of nine members who shall serve without compensation, but who may be reimbursed for necessary and reasonable expenses. The members shall consist of the members of Council, the Mayor and the Borough Manager. The members of the Educational Service Agency shall not, by reason of membership therein, forfeit the right to exercise the powers, perform the duties, or receive the compensation of the Borough offices held by them during such membership.
All school crossing guards are hereby transferred to the payroll of the Educational Service Agency, effective January 1, 2009, and shall be compensated from the accounts of the Educational Service Agency in conformity with Act No. 108 of 1979.
All school crossing guard payroll funds, accounts and records of the Borough shall be transferred to and designated as the accounts of the Educational Service Agency. The Borough Manager is hereby authorized to establish a new bank account for payment of the employees of the Educational Service Agency and to take all necessary action in order to provide for the payment of the employees of the Educational Service Agency.
The Borough Manager is hereby directed to transfer sufficient funds from time to time to the Educational Service Agency for compensation of the school crossing guards for the school year which began in August 2008 and at such time as necessary thereafter. The Borough Manager is directed to obtain reimbursement from the Keystone Oaks School District on behalf of the Educational Service Agency for 1/2 of the Educational Service Agency's costs for the school crossing guards, unless otherwise provided by agreement of the Borough and the school district.
