[Adopted by the City Council of the City of Lake Mills 12-15-2009 by Ord. No. 1054 as Title 3, Ch. 7, of the 2009 Code of Ordinances. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
JUNK DEALER
Any person engaged in the business of collecting, peddling, dealing in, or storing waste paper, rags, old metals, or other materials commonly known as "junk."
MOTOR VEHICLE SALVAGE BUSINESS
Shall consist of the business of dealing in, breaking up, or storing dismantled or salvaged motor vehicles.

A. 
Requirement; fee.
(1) 
No person shall engage in business as a junk dealer or in the motor vehicle salvage business without having first obtained a license from the City Council to carry on such business. Application for such license shall be made on forms furnished by the Clerk and shall state the name of the applicant, the location of his place of business and of his shop or yard and the description of any vehicles to be licensed. In the case of a license for a junk dealer, the fee shall be as set from time to time by City Council.

Upon approval by the Council and payment of the license fee, the license shall be issued, signed by the City Manager and Clerk. Such license shall expire on June 30 following its issue. Every such license may be revoked for cause, and none of the licenses herein mentioned shall be transferable.
B. 
Revocation. Upon complaint being made in writing by any municipal official or resident of the City to the Clerk that any licensee has violated any provisions of this section, the City Council shall summon such licensee to appear before it at the time specified in the summons, which shall be not less than three days after the date of the service thereof, to show cause why his license shall not be revoked. The Council shall proceed to hear the matter and if it finds the allegation of said complaint to be true, it may revoke such license or suspend the same for a specified time.
All licenses granted hereunder shall be granted subject to the following conditions and other conditions of this chapter, and subject to all other ordinances and regulations of the City applicable thereto.
A. 
Consent to entry. Every applicant procuring a license thereby consents to the entry of the police or other duly authorized representatives of the City at all hours for the purpose of inspection and search, and consent to the removal from said premises of all things and articles there had in violation of City ordinances or state laws and consents to the introduction of such things and articles in evidence in any prosecution that may be brought for such offenses.
B. 
Sanitary, safety requirements.
(1) 
Said premises and all structures thereon shall be so situated and constructed that the business may be carried on in a sanitary manner, shall contain no fire hazards, and shall be arranged so that thorough inspection may be made at any time by the proper health, fire, building and police authorities.
(2) 
All necessary steps must be taken to eliminate rodents and vermin.
C. 
Fence required. Every premises or enclosure, except a completely enclosed building used in the conduct of the junk dealer's business or the motor vehicle salvage business abutting or facing a residential district, shall be enclosed by a tight fence or wall of uniform material and construction, no less than six feet nor more than eight feet in height, erected in such a manner as to obstruct the premises from public view. In all other cases, such premises or enclosure shall have a substantial fence not less than eight feet high along the street line. Such fence or wall shall be maintained at all times in good condition by the licensee.
D. 
Operation within building. The motor vehicle salvage business shall be conducted entirely within a building, except that not more than six parts of six motor vehicles may be permitted to remain in the open, provided that no one vehicle shall remain in the open for more than 30 days.
E. 
Moving business. No licensee shall remove his place of business from the place designated in the license until written permission has been secured from the City Council and the same endorsed upon the license. No licensee shall carry on the business at or from any other place than the one designated in the license thereof. Nor shall said business be carried on after such license has been revoked or has expired.
No licensee shall operate his business between the hours of 8:00 p.m. and 6:00 a.m., except in the case of an emergency, and the wrecking of motor vehicles or farm implements shall not be conducted on Sundays or legal holidays.
No licensee shall purchase from any minor under 18 years of age any junk or metals of any kind or description whatever without the written consent of the parent or guardian of such minor.
