As used in this chapter, the following words and phrases shall
have the meanings given to them in this section:
The Borough of Port Vue.
Any indoor or outdoor facility, owned by the Borough, and
used by the general public, including any park or recreational facilities,
or serving as a place of work for public employees or a meeting place
for a public body.
The carrying of a person of a lighted cigar, cigarette, pipe
or other lighted smoking device.
Smoking shall be prohibited on all Borough-owned property and
public places, including all park areas owned by the Borough, all
Borough recreational facilities, and all other areas, whether areas
at said facilities as posted and/or specifically designated by the
Borough.
A.
A first violation of this section shall be punishable by a civil
tine of $50. A second violation of this section shall be punishable
by a civil fine of $100. Third and subsequent violations of this section
shall be punishable by a civil fine of not more than $250.
B.
Furthermore, in addition to the penalties set forth above, any Borough
employee that violates the provisions of this section shall be subject
to such disciplinary action as deemed appropriate by the Borough for
a final decision.
The Borough Police Department, in addition to any other Borough
department as approved by Council, shall have full authority to enforce
this chapter, and to issue such citations as necessary for any violations
of this chapter.
