A. A certain
document, one (1) copy of which is on file in the office of the City
Clerk of City of Battlefield, Missouri, being marked and designated
as the "2017 Edition of the ICC Al 17.1-2017 Accessible and Usable
Buildings and Facilities," as published by the International Code
Council, be and is hereby adopted as the Accessible and Usable Buildings
and Facilities Code of the City of Battlefield, in the State of Missouri,
for regulating and governing conditions and maintenance of all property,
buildings and structures; by providing the standards for facilities
and other physical things and conditions essential to ensure that
structures are safe, sanitary and fit for occupation and use; and
each and all of the regulations, provisions, penalties, conditions
and terms of said building code on file in the office of the City
Clerk are hereby referred to, adopted, and made a part hereof, as
if fully set out in this Article.
B. Nothing
in this Article or in the building code hereby adopted shall be construed
to affect any suit or proceeding impending in any court, or any rights
acquired, or liability incurred, or any cause or causes of action
acquired or existing, under any act or ordinance repealed by Ordinance
No. 19-03; nor shall any just or legal right or remedy of any character
be lost, impaired or affected by this Article.

Any person violating any of the provisions of this Article or
the Code adopted in this Article shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.
