A. 
A certain document, one (1) copy of which is on file in the office of the City Clerk of City of Battlefield, Missouri, being marked and designated as the "International Fire Code, 2018 Edition," as published by the International Code Council, be and is hereby adopted as the Fire Code of the City of Battlefield, in Greene County, in the State of Missouri, for the control of fire safety of buildings and structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the City Clerk are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.
B. 
The following sections are hereby revised:
1. 
Section 101.1 Title. Insert into the bracketed area: "City of Battlefield, Missouri."
2. 
Section 105.6.4 Carnivals and fairs. Delete in its entirety.
3. 
Section 105.6.12 Dry cleaning. Delete in its entirety.
4. 
Section 105.6.15 Fire hydrants and valves. Delete in its entirety.
5. 
Section 105.6.17 Floor finishing. Delete in its entirety.
6. 
Section 105.6.18 Fruit and crop ripening. Delete in its entirety.
7. 
Section 105.6.19 Fumigation and insecticidal fogging. Delete in its entirety.
8. 
Section 105.6.27 LP-gas. Delete in its entirety.
9. 
Section 105.6.33 Open flames and torches. Delete in its entirety.
10. 
Section 105.6.34 Open flames and candles. Delete in its entirety.
11. 
Section 110.4 Violation penalties. Insert into the bracketed area: "Refer to Section 500.180 for penalties."
12. 
Section 112.4 Failure to comply. Insert into the bracketed area: "Refer to Section 500.180 for penalties."
13. 
Section 506.1.1 Locks. Revise this section to read: "The key box shall be a 'Knox Box,' as purchased from Knox Company, 1601 W. Deer Valley Road, Phoenix, AZ 85027. It shall be installed with the bottom of the vault six (6) feet above the finished grade, at the main entrance of the building or at a location designated by the Battlefield Fire Protection District Fire Chief or his/her designee. In multibuilding complexes the Fire Chief or his/her designee shall determine if multiple boxes shall be required."
14. 
Section 1103.5.3 Sprinkler systems Group I-2, Condition 2. Insert into the bracketed area: "By December 31, 2019."
15. 
Section 5704.2.9.6.1 Locations where above-ground tanks are prohibited. Amend as follows: "Storage of Class I and II liquids in above-ground tanks in control areas exceeding an aggregate capacity of 250 gallons (946 L) outside of buildings is prohibited for the protection of heavily populated or congested areas.
"EXCEPTION: When approved by the Planning or Zoning Commission and when approved by the Fire Code Official.
Note: The Fire Code Official may require UL2085-listed protected tanks or other appropriate mitigation measures."
16. 
Section 5706.2.4.4 Locations where above-ground tanks are prohibited. Amend as follows: "The storage of Class I and II liquids in above-ground tanks in control areas exceeding an aggregate capacity of 250 gallons (946 L) outside of buildings is prohibited for the protection of heavily populated or congested areas.
"EXCEPTION: When approved by the Planning or Zoning Commission and when approved by the Fire Code Official.
Note: The Fire Code Official may require UL2085-listed protected tanks or other appropriate mitigation measures."
17. 
Section 5806.2 Limitations. Amend as follows: "Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited within the City limits of Battlefield, Missouri."
18. 
Section 6104.2 Maximum capacity within established limits. Amend as follows: "Within the limits established by law restricting the storage of liquefied petroleum gas for the protection of heavily populated or congested areas, the aggregate capacity of any one (1) installation shall not exceed a water capacity of 1,000 gallons (3,785 L)."
C. 
It shall be the duty of the Battlefield Fire Protection District Fire Chief, Fire Fighters, City of Battlefield Police Chief, Police Officers and the City of Battlefield Building Inspector to report any and all violations of this Chapter to the appropriate City Officials for action.
D. 
Nothing in this Article or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance repealed by Ordinance No. 19-07; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

Any person violating any of the provisions of this Article or the Code adopted in this Article shall be deemed guilty of an ordinance violation and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
