The cable television franchise agreement between Tullytown Borough and Comcast attached to this article is duly adopted upon the effective date of this article and the franchise agreement as both an ordinance and agreement of Tullytown Borough.[1]

The cable television franchise agreement between Tullytown Borough and Comcast attached to this article shall be designated as new Article IV of Chapter A190 of the Tullytown Borough Code of Ordinances.
The cable television franchise agreement between Tullytown Borough and Comcast attached to this chapter is deemed to be a replacement of the existing franchise ratified at Ordinance No. 327. To the extents rights, liabilities and privileges exist between Comcast and Tullytown Borough that are necessarily vested and/or justiciable under the existing franchise, Ordinance No. 327 is preserved from repeal to the extent necessary.[1]

In addition, all inconsistent provisions of other ordinances or resolutions are repealed to the extent of the inconsistency. All other provisions of the ordinances of Tullytown Borough shall remain in full force and effect.
The provisions of this article are declared to be severable. If any provision of this article is declared to be invalid or unconstitutional by a court of competent jurisdiction, such determination shall have no effect on the remaining provisions of this article.
This ordinance shall be effective immediately.
