There is hereby created under the terms of this chapter a Sewer Utility within the Borough of Barrington, in the County of Camden, New Jersey, which Utility shall be publicly owned and shall, for accounting purposes, be a separate entity, having its own borrowing capacity, its own separate property, whether it is real, personal or mixed. The name by which it shall be known shall be the "Borough of Barrington Sewer Utility."
It shall be the function of the Sewer Utility to own and operate all sewer facilities, plants, lines and equipment pertaining to the handling of sewage and the treating of sewage in and for the Borough of Barrington.
The Sewer Utility shall be governed by the ordinances and resolutions of the Mayor and Council of the Borough of Barrington. The financial affairs of the Sewer Utility shall be governed by the Mayor and Council of the Borough of Barrington. The Mayor and Council of the Borough of Barrington shall have full authority to appoint and employ all necessary employees for the Sewer Utility; however, the salary of said employees or appointments of the Sewer Utility shall be paid from separate funds of said Utility.

A. 
The Sewer Utility shall be, from time to time, authorized to borrow money on its own credit by ordinances adopted according to law by the Mayor and Council of the Borough of Barrington.
B. 
The Sewer Utility may, from time to time, acquire such real and personal property as may be authorized by the Mayor and Council of the Borough of Barrington by duly adopted ordinance according to the laws of the State of New Jersey.
C. 
The Sewer Utility shall have the authority to enter into a working agreement with adjoining municipalities under which agreement or arrangements the Sewer Utility may under contract transmit sewage and waste of other municipalities through its lines to the Camden County MUA facilities.

D. 
The Sewer Utility shall have the authority, when authorized, to acquire lands and/or rights-of-way that are outside the municipal bounds of the Borough of Barrington which may be necessary to effect proper sewage treatment and transmittal of waste, whether it is for a site on which a sewer plant shall be built or whether it is needed for placement of other equipment, such as sewer lines, etc.
E. 
The Sewer Utility shall only be responsible for the maintenance and operation of the sewer mains, manholes and pump stations within the rights-of-way and easements owned by Barrington Borough. It shall be the responsibility of the property owner to maintain and repair the lateral sewer from any buildings on the property to the sewer main connection. The Sewer Utility shall not be responsible for any damage from overflow of any plumbing fixture or open or broken sewer pipe that is located below grade level within the property.

F. 
The Sewer Utility shall, from time to time, when necessary, be permitted to receive moneys from the general funds of the Borough of Barrington, whether by grant or loan.
G. 
A permit to do repairs or replacements to any lateral located within the right-of-way or easements of the Barrington Sewer Utility shall be required. A fee of $30 shall be charged for this permit. All work must be inspected by the Borough Sewer Inspector before it is covered with dirt. (Note: Any work performed within the Borough-owned streets will still require a street opening permit.)

H. 
All new and replacement building sewer lines within the streets of the Borough of Barrington shall be constructed of schedule "80" plastic pipe or better. All connections to the sewer mains shall be done with the use of the appropriate size saddle. A double sweep tee with riser pipe and cap shall be placed behind the curbline for the purpose of venting and cleaning the line. No other materials shall be used without the permission of the Borough Sewer Inspector. The tee shall rest on an eight-inch minimum depth cast iron or precast concrete support. The cap shall be set flush with the finished grade.

A. 
The Borough governing body shall appoint a collection system operator with a license as required by law as the license holder and operator of the sewer collection system and all of its equipment.
B. 
The responsibilities of the licensed operator are to oversee the maintenance and operation of the sewer mains and pump stations and report the conditions directly to Mayor and Council. The Licensed Operator shall have the authority to effect emergency repairs as necessary to prevent environmental damage and health problems. The Director of Public Works and/or Mayor shall be notified as soon as possible when an emergency happens.
Said operator shall furnish his own transportation to and from such duties within the Borough limits, but the Borough shall furnish transportation for the moving of equipment or additional labor when it is required in the performance of such operations or maintenance or for the operator when it becomes necessary for the Sewage Committee to send him beyond the Borough limits.

The Mayor and Council shall appoint a Sewer Inspector each year on the first of January. The compensation shall be fixed annually in the nonunion salary ordinance.

The Sewer Inspector shall possess at the time of appointment a license as required by state law.

The Sewer Inspector shall inspect any and all new laterals and connections, and repairs to laterals and connections to the Borough's collection system. He will keep adequate records of these inspections and may enforce all Borough regulations on sewer connections. The Inspector shall report to Mayor and Council.
