With the exception of commercial establishments and unless prior approval is granted by the Commissioner of Public Works or his/her division head, agent or designee, no collections shall be made on Sundays or holidays. Under no circumstances shall collections commence earlier than 6:00 a.m., and all collection work shall stop at 6:00 p.m.
No vehicle used by the licensed refuse collector shall travel into a residential driveway for the purpose of collecting garbage or refuse without the consent of the homeowner.
Collectors are not responsible for brush, bulk refuse, garbage, refuse or yard trimmings that originate at any residence or establishment other than the owner's or customer's. Solid waste generated or originated within the Town of Webster which has been left for collection or which is delivered by the generator of such waste to a facility shall be disposed of as follows:
A. 
Waste delivery and disposal.
(1) 
Prior to initial collection or transportation, such solid waste shall be source-separated by the generator into recyclable materials and remaining solid waste as provided in the rules and regulations promulgated hereunder.
(2) 
Recyclable materials shall not be commingled with other solid waste during collection, transportation or storage following collection. The Town of Webster may order such exceptions as it determines are in the public interest.
(3) 
All recyclable materials generated or originated within the Town of Webster must be delivered to an authorized recycling facility or handled through a waste stream reduction program.
(4) 
No authorized recycling facility or waste stream reduction program shall receive recyclable materials generated or originated within the Town of Webster except as permitted by law.
(5) 
Disposal of solid waste which is barred from all authorized recycling facilities by rules, regulations or orders promulgated pursuant to this chapter, the Monroe County Solid Waste Reuse and Recycling Law or by any other law, regulation or ordinance shall not otherwise be regulated by this chapter.
(6) 
No hazardous waste may be delivered to an authorized recycling facility.
B. 
Preparation of recyclables for collection.
(1) 
Recyclables shall be prepared for collection in accordance with guidelines provided by the refuse collectors and approved by the Town or otherwise established by the Town. Haulers shall provide curbside collection of recyclables. Recyclables to be picked up must be set out in appropriate containers as specified by the Commissioner of Public Works or his/her division head, agent or designee, or any subsequent and pertinent ordinance or law, and be at the curb no later than 6:00 a.m. on the day of collection, and no material may be placed at the curb before evening on the day preceding the scheduled collection day.

(2) 
All refuse haulers must be in compliance with the Monroe County Solid Waste Recycling Law.
C. 
Preparation of yard waste for collection.
(1) 
All brush must be cut to a length of not more than four feet. All branches/brush under two inches in diameter must be bundled. The bundles should be bound with rope or twine (not wire), should not weigh more than 60 pounds and should not be more than 16 inches across.
(2) 
Yard waste material which is not properly prepared or which exceeds the volume and/or weight requirements will not be collected. The resident will be responsible for making alternate arrangements for collection within seven days of generation.
D. 
Preparation of garbage/refuse.
(1) 
Garbage/refuse shall be stored in proper containers. Such receptacle shall be a container of sufficient capacity, and said container shall have handles, a tight-fitting cover and shall be watertight. All such receptacles shall be securely closed at all times. Wheelbarrows, lawn carts, fifty-five-gallon drums, fiber barrels and waste baskets are not considered suitable containers for collection of garbage/refuse.
(2) 
Garbage/refuse to be picked up must be set out for collection no later than 6:00 a.m. on the day of collection, and no material may be placed at the curb before the evening of the day preceding the scheduled pickup day.
E. 
Construction and demolition waste.
(1) 
Remodeling, construction and demolition debris, road waste and debris resulting from the repair of utilities and roadways and residential property structures shall be collected and disposed of by the municipality, utility or private contractor performing such work and generating the material.
(2) 
Remodeling debris generated by the homeowner shall be collected by the refuse hauler. Refuse collectors shall collect up to an amount as would fit into a five foot by five foot square, and three feet high, or equivalent volume. If the amount generated by the resident exceeds this amount, the resident is responsible for making alternative collection arrangements within seven days of generation. All material must be in containers not weighing more than 60 pounds each.
A. 
Trash for disposal and recyclables may be placed at the curb on the evening before the expected day of pickup, provided that wherever practicable, the material is placed in suitable receptacles, and provided that the receptacles are returned from the curb by the house owner within a reasonable time on said day of collection.
B. 
Only persons who are acting under authority of the county or an authorized hauler shall collect, pick up, remove or cause to be collected, picked up or removed any solid waste recyclable materials so placed for collection; each such unauthorized collection, pick up or removal shall constitute a separate violation of this chapter; provided, however, that where the county or an authorized hauler has refused to collect certain recyclable materials because they have not been separated, placed or treated in accord with the provisions of this chapter or the Monroe County Solid Waste Reuse and Recycling Law, the person responsible for initially placing those materials for collection may and shall remove those materials from any curb, sidewalk or street side.
C. 
Nothing herein shall prevent any person from making arrangements for the private collection, sale or donation of recyclable materials, provided that recyclable materials to be privately collected, sold or donated shall not be placed curbside on or immediately proceeding the day for collection of such recyclable materials. Any and all recyclable materials placed in a hauler-supplied container at curbside or at any designated collection place shall immediately become the property of the hauler.
D. 
Haulers shall offer or cause to be offered collection services for all recyclable materials to all residential customers for whom they provide solid waste collection services, on the same days as solid waste collection services are provided, unless otherwise authorized by the regulations.
If the collector provides a receptacle for the collection and transportation of garbage and household refuse, said receptacle will be permanently marked with the name and phone number of the collector.
