The purpose of this chapter is to promote the health, safety and general welfare of the Town of Webster, to regulate and enforce regulations concerning the use of skateboard ramps and to ensure and not interfere with the quiet enjoyment of property owners within said town.
As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A platform device which is constructed of wood, plastic, metal, fiberglass or other materials to which wheels are attached. For the purposes of this chapter, roller skates shall be excluded from the definition of a "skateboard."
SKATEBOARD RAMP
Any structure or improvement located on private property which is used for the purpose of riding or propelling a skateboard, motorcycles, motorized bicycles, trail bicycles or roller skates. This definition shall not include portable skateboard ramp units, commonly known as "quarter pipes," or any skateboard facility which is less than three feet in height.
A. 
Skateboard ramps shall be prohibited:
(1) 
Within any right-of-way or private roadway.
(2) 
In any location forward of the rear building line, as extended, of the principal structure upon a particular lot.
B. 
Skateboard ramps must comply with all minimum rear yard and side yard zoning setback requirements but in no case shall be constructed less than 30 feet from any adjoining property boundary.
C. 
Skateboard ramp construction.
(1) 
No skateboard ramp shall be in excess of six feet in overall height, excluding handrails. All building construction shall include insulation or other sound-deadening materials and shall be designed and constructed in a safe, workmanlike manner. Closure of the open ends of a skateboard ramp shall be required, and orientation of the skateboard ramp shall direct noise away from adjacent properties wherever possible. Owners of said facilities shall be encouraged to buffer, landscape or otherwise screen or contain the noise generated by skateboarding activities on their property.
(2) 
The Town of Webster shall assume no responsibility for the design, safety, structural integrity or otherwise in its issuance of a building permit for a skateboard ramp, which shall be the sole responsibility of the applicant/owner thereof.
D. 
The construction of a skateboard ramp shall require issuance of a building permit, in accordance with §§ 119-13 and 119-14 of Chapter 119 of the Code of the Town of Webster. The fee for a building permit for each skateboard ramp shall be as set by the Town Board by resolution.

E. 
Skateboard ramp use must comply with all current or future noise ordinances.
F. 
Only one skateboard may be used on a skateboard ramp at a time. Users must wear protective safety equipment.
G. 
Skateboard ramps shall be used only between the hours or 11:00 a.m. to 7:00 p.m., or until 8:30 p.m. during daylight saving time.
Any appeals related to the provisions of this chapter shall be reviewed by the Town of Webster Zoning Board of Appeals.

A person who violates any provision of this chapter, who violates or fails to comply with any order or regulation made pursuant to this chapter, who builds in violation of any specification or development plan approved and filed under this chapter, who violates any permit issued under this chapter or who continues to work on, operate or use a skateboard ramp facility after service of notice, in writing, from the Building Inspector to discontinue such activities shall forfeit and pay a fine of not more than $500 for each offense. Each week any such violation continues unresolved shall constitute a separate offense.
