[HISTORY: Adopted by the Town Board of the Town of Webster 12-11-1969 as L.L. No. 5-1969(Ch. 56 of the 1991 Code). Amendments noted where applicable.]
There shall be in the Town of Webster a Department of Public Works.

A. 
The principal executive officer and administrative head of such Department shall be the Commissioner of Public Works, who shall be appointed by and serve at the pleasure of the Town Board and for a compensation fixed by said Board.
B. 
The Commissioner of Public Works shall be appointed on the basis of his administrative experience and qualifications for the duties of such office and shall be in the unclassified service.
C. 
The Commissioner of Public Works shall also have all the powers and be subject to all of the duties of a Town Superintendent of Highways.

There shall be within the Department of Public Works the following divisions: Community Development, Engineering, Highway and Sewer, together with such other and further divisions as may from time to time hereafter be deemed necessary and established by the Town Board. Each of said divisions shall be supervised by an administrative officer who shall be a director of such division. Such director shall be appointed by the Town Board and have the powers and duties of the Commissioner of Public Works in his/her absence.

The Department of Public Works shall have the following powers and duties, to be exercised under the general supervision of the director of the division indicated:
A. 
Community Development Division: to have oversight of building plan review, land use planning and zoning administration, permitting, inspection and compliance, property maintenance code enforcement, and building/fire inspection. To manage community development services and activities including the processing of land use applications and coordinating code compliance.
B. 
Engineering Division: to provide professional engineering advice to the town and supervise inspection of construction within the town. To supervise preparation of plans for major public works projects, and the preparation of legal descriptions for deeds and easements.
C. 
Highway Division: to have exclusive charge and supervision of the design, construction, repair, maintenance, cleaning and lighting of all highways, roads, streets, culverts, bridges, parking facilities and stormwater drainage systems under the jurisdiction of the town or any special district or agency thereof.
D. 
Sewers Division: to construct, operate and maintain sewers, pumping stations, force mains, treatment plants and other facilities for the collection, conveyance and disposal of all sanitary sewage within the Town of Webster and the sanitary sewer districts established and existing in the town and to perform such duties and exercise such powers as may be granted to the town by Chapter 257, Sewers, of this Code.[1]

The Commissioner of Public Works or his/her division heads or agents or designees, with the consent of the Town Board, may from time to time employ such additional persons, including such special engineering, architectural or other technical counsel, as may be necessary to the performance of the duties imposed upon the Department of Public Works.

All employees of the Department of Public Works shall be under the general supervision and control of the director of the applicable division and may be removed by him/her for cause in accordance with applicable procedures and regulations of the Civil Service Commission.
All costs and expenses incurred by the Department or its officers, agents or employees on behalf of a special improvement district or special town project shall be charged against such district or project and paid from the funds duly appropriated for the purpose of such district or project.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Board contained in § 61 or 64 or Articles 12, 14 and 15 of the Town Law of the State of New York or any other powers which may be lawfully exercised by said Board or the presiding Supervisor.
