The Town Board of the Town of Webster, which is a suburban town under the provisions of Article 3-A of the Town Law of the State of New York, takes cognizance of the fact that the Town of Webster maintains and operates an extensive Sewer Department and Public Works Department. The orderly management of government requires the creation of the office of Deputy Commissioner of Public Works in order to ensure the effective administration and efficient operation of the Sewer Department and Public Works Department, and to be the Acting Commissioner of Public Works and have all the authority and duties of, and act for and in place of, the Commissioner of Public Works in the event of the absence or disability of the Commissioner of Public Works.
A. 
There is hereby created the office of Deputy Commissioner of Public Works of the Town of Webster, Monroe County, New York.

The Town Board shall appoint each department head and/or deputy department head.
B. 
Each department head and/or deputy department head shall hold office until the first day of January next succeeding the first biennial Town election held after his or her appointment and thereafter shall hold office for the term of two years and until his or her successor shall have qualified; provided, however, that the appointees to such offices shall be removable at the pleasure of the Town Board.
C. 
A vacancy in the office of a department head and/or deputy department head occurring other than by the expiration of term of office shall be filled only for the remainder of the unexpired term.
D. 
The Town Board shall fix the compensation, if any, to be received by each department head and/or deputy department head.
The Deputy Commissioner of Public Works shall be the Acting Commissioner of Public Works and shall have all the authority and duties of, and act for and in place of, the Commissioner of Public Works in the event of the absence or disability of or in the event of a vacancy in the office of the Commissioner of Public Works.
A. 
Each department head and/or deputy department head shall, before entering upon the duties of the office, take and file with the Town Clerk an oath of office.
B. 
The Town Board may require a department head and /or deputy department head to file a bond for the faithful performance of duties.
