As used in this chapter, the following terms shall have the meanings indicated:
BATTING CAGES
All Borough-owned or -leased facilities open either in whole or in part to Bellmawr baseball and softball organizations for recreational use.
The Borough Council is authorized to establish community center rules and regulations to govern the use of batting cages.
A. 
A facility use permit shall be obtained from the Borough Clerk or Recreation Department by any person, organization or group desiring to reserve any portion of a batting cages who is affiliated with Bellmawr baseball and/or softball for any practice activity.
B. 
Applicants must apply for a facility use permit at least two weeks prior to the requested date(s) of use. Facility use permit applications shall reflect the use date(s), hours of use, age group and anticipated number of participants and type of activity proposed.
C. 
Permitted activities shall be confined to the specific area of the batting cages designated in the permit.
D. 
All facility use permits shall be immediately revocable by the Borough Clerk, Recreation Department, or authorized designee upon determination that a violation of any rule, Borough ordinance or state statute has occurred.
E. 
All persons, organizations or groups using any portion of a community center under a facility use permit must vacate the premises by _____ p.m. unless otherwise authorized, in writing, by the Borough Clerk, Recreation Department or authorized designee.
Any organization, group or person using the batting cages under a use permit shall indemnify the Borough for any and all damage to any part of the facility by any person attending the activity and all liability and damages to any person for injuries, including death. Insurance shall be required by the Borough of at least $1,000,000. Failure to provide proof of insurance will result in the permit being denied or revoked.
Use of the batting cages is limited to residents.
The Borough Council is authorized to establish batting cage use fees and to change fees from time to time.
A. 
At the discretion of the Borough Clerk, Recreation Department or authorized designee, all activities at batting cages shall require the supervision of an adult, and the use permit holder shall assume full responsibility for any damage to the batting cages or equipment therein that is caused by participants under the use permit.
B. 
The Borough Council may designate a Borough employee to oversee activities of permit holders.
A $20 refundable key fob deposit is required for use of the batting cages.
The individual or entity using the batting cages shall be responsible for cleanup immediately following the usage and for any damage to the batting cages. In the event the responsible party fails to clean up, or if the cleanup is not acceptable to the Borough, any additional costs to clean up or for damage to the batting cages shall be charged to the permit holder.
The total number of people admitted to the batting cages for any use shall not exceed capacity as determined by the Bellmawr Fire Inspector.
The use of equipment at the batting cages shall be permitted only when specified in the use permit application.
No material of any kind shall be attached to any part of the batting cages without express, written approval from the Borough Clerk, Recreation Department or authorized designee.
Concession rights at batting cages shall be reserved to the Borough unless specifically requested by the applicant and approved in the use permit.
The use of tobacco, cannabis or any other substance at batting cages is strictly prohibited.
The use or consumption of intoxicating beverages at the batting cages is prohibited.
Persons or groups utilizing the batting cages must obey all federal, state, county and Borough laws and ordinances.
