This chapter shall govern all acts, conduct and usage of the parks and lands which shall be under the administration of the Mayor and Council of the Borough of Rockaway and the Director of the Department of Parks and Recreation as provided for and set forth herein and Chapter 201 of the Borough Code.
As used in this chapter, the following words, terms and their derivations shall have the following meanings unless their use in the text of this chapter clearly demonstrates a different meaning:
PARKS AND RECREATIONAL FACILITIES or PARK
Includes all public parks, playgrounds, athletic fields, beaches, recreation facilities and parking lots publicly owned or under the control or supervision of the Borough of Rockaway and all property owned or under the control or supervision of the Borough of Rockaway upon which the public is invited or upon which the public is permitted and where individuals gather for recreational activities and all areas adjacent to such lands or facilities, including but not limited to any parking area, driveway or drive aisle.
A. 
State and federal laws. The regulations of this section and established pursuant to this chapter for parks and recreational facilities are subject to the enabling authority of the State of New Jersey and are subject to compliance with all state and federal statutes and regulations. If any provision of this section or of this chapter is inconsistent with the statutes and/or regulations of the State of New Jersey or of the federal government, the state or federal statutes and regulations shall prevail. Nothing in this chapter shall be construed to supersede any applicable federal or state laws.
B. 
Operation of vehicles. No person shall drive, ride or operate any type of motor vehicle, including any off-road vehicle, all-terrain vehicle, dirt bike, snow mobile or similar motorized equipment, within or upon any walkway, trail, grounds or any part of a park or recreational facility not otherwise designated or customarily used for such purpose or to which vehicle access is closed or restricted and duly marked by signs, markings or barricades, unless otherwise expressly authorized by the Borough and except that this shall not be construed to apply to police, emergency and Borough vehicles.
C. 
Hunting and Removal of Wildlife. No person shall kill, hunt, trap, molest, harm, wound, frighten, chase, remove or have in his/her possession any animal, reptile, amphibian, waterfowl, bird, fish or other wildlife or the eggs, nest or young of any such any animal, reptile, amphibian, waterfowl, bird, fish or other wildlife.
D. 
Fires. No person shall kindle, build, maintain or use a fire of any type, including charcoal, propane or gas burners or stoves, without the express authorization of the Mayor and Council of the Borough of Rockaway.
E. 
Littering or dumping. No person shall dump, deposit, throw or leave garbage, litter, refuse, trash or other waste items on any grounds or in any water in or contiguous to any park, except in designated receptacles where these are provided. Where receptacles are not so provided, all such garbage, litter, refuse, trash or other waste items shall be carried away from the park or recreational area by the person responsible for its presence, and properly disposed of elsewhere. All recyclable material shall be placed within the appropriate designated container.
F. 
Domestic animals. No person shall cause or permit any dog, cat, horse or other animal owned by him/her or in his/her custody or control to go or be in any park area, except that, as specified in this chapter, dogs shall be permitted in specifically designated areas when properly leashed or as otherwise authorized under state or federal law. Any such person shall promptly dispose of any feces or waste in the proper receptacle.
G. 
Parking on grass areas. No owner or driver shall park any vehicle on any grass or field area or anywhere outside of designated parking spaces.
H. 
Digging and/or removal of natural fauna, floral and other material. No person shall dig, remove, damage or cut, carve or transplant or remove any soil, sand, gravel, rock, stones, trees, shrubs, plants or other natural life, make any excavation by tool, equipment or other means or otherwise in anyway disturb the natural beauty or usefulness of any park area, nor shall any person attach any rope, wire or other contrivance to any tree or plant; except as may be otherwise expressly authorized by the Borough.
I. 
Pollution of waters. No person shall throw, discharge or otherwise place or cause to be place in the waters of any pond, lake, river, stream, brook, fountain or other body of water in or adjacent to any park or any tributary, stream, storm sewer or drain flowing into such waters, any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters.
J. 
Possession and consumption of alcoholic beverages. No person shall possess any unsealed alcoholic beverage container or consume any alcoholic beverage within a park or recreational facility, except as otherwise authorized by the Mayor and Council of the Borough of Rockaway or pursuant to special permit or permission under such terms and conditions, and for such duration, as may be established by the Borough.
K. 
Feeding waterfowl or other animals. Notwithstanding § 121-13 or any other provision of the Borough Code to the contrary, no person shall feed or attract any animal, reptile, waterfowl, bird or other wild animals, nor shall they give, offer, or attempt to give any animal, reptile, waterfowl, bird or other wild animal any tobacco, alcohol or other known noxious substance, except that this shall not be construed to apply to any authorized officer or official of the Borough, state, federal or other government or regulatory agency and their authorized contractors and agents.
L. 
Golf and archery. No person shall take part in any golf or archery activity.
M. 
Overnight camping. No person shall be permitted to camp overnight or erect or maintain a camping site or tent in any park.
N. 
Signs. No person shall place, post or affix any sign, poster, advertisement or other display in any Borough park or recreational facility without the express approval of the Borough Administrator and/or Recreation Director.
O. 
Public property. No person shall willfully mark, deface, disfigure, injure, tamper with or remove any structures, buildings, signs, notices, placards, posts, fences, sidewalks, tables, benches, sporting equipment, park property or parts or appurtenances thereof, whatsoever, either real or personal.
P. 
Fireworks. No person shall use, set off or otherwise cause to ignite, explode or discharge or burn any fireworks, firecrackers or other explosive or flammable pyrotechnics or material in any park or recreational facility within the Borough, without the prior express written authorization of the Mayor and Council.
Q. 
Ice skating. No person shall ice skate or go upon any ice, except at such times and upon such places as may be specifically designated by the Borough and duly marked and identified by posted signs.
R. 
Closed grounds and facilities. No person shall enter upon any area or portion of a Borough Park or Recreational Facility that has been designated closed or restricted as indicated by the posting of a notice "Closed," "Park Closed," "No Trespassing," "Restricted Area," "Keep Out," or other similar notice to that effect and/or placement of a physical barrier.
S. 
Park and facility closure. No person shall remain within any park or recreational facility when closed to the public, or after or before the posted closing or opening time, except during those times when authorized events or activities are conducted or as otherwise authorized by the Mayor and Council, Borough Administrator or Recreation Director.
T. 
No organized activity shall be allowed at any park or recreational facility within the Borough of Rockaway, except upon express written approval of the Director of Parks and Recreation or his or her designee. Each group shall be required to complete and submit the requisite application and provide the necessary insurance certificates and other documentation as may be required in accordance with Chapter 201 of the Borough Code, the rules and regulations governing the use of Borough parks and recreational facilities or as otherwise directed by the Director of Parks and Recreation or his or her designee.
A. 
Except as otherwise provided in this chapter, the operating hours for each park and recreational facility shall be as posted therein and as specified herein as follows:
(1) 
Playgrounds: Sunset to sunrise daily.
(2) 
Lighted basketball and hockey court: Sunrise to 10:00 p.m. at Memorial Park.
(3) 
Unlit basketball courts: Sunset to sunrise daily at Centennial Park.
(4) 
Park areas: All park areas for which the hours of operation are not otherwise specifically established within this chapter and posted therein, shall be closed daily from sunset to sunrise.
(5) 
Park lake walkway only: open at all times unless otherwise posted.
B. 
Notwithstanding anything herein to the contrary, parks and recreational facilities shall be considered open for the duration of any authorized activity or event.
In addition to the Borough Police Department, violations of the provisions and requirements of this chapter may also be enforced by any other authorized officer or official of the Borough authorized or empowered to enforce the provisions of the Borough Code. Notwithstanding and in addition to any other penalties, remedies or relief authorized by law, any violation of this chapter shall also be subject to prosecution and enforcement under any other applicable provision of the Borough Code.
In addition to any other penalties as may be authorized by law or pursuant to the Borough Code and except as otherwise specified in any other provision of this chapter, any person found to be in violation of any provision of this chapter shall, upon conviction, for each such violation, be subject to a fine of not less than $250 nor more than $750 or imprisonment for a term of not more than 90 days.
Nothing in this chapter shall be construed as repealing or amending any provision of any other municipal ordinance which, by its terms, regulate, or set standards for use, activity or conduct in parks and recreational facilities, or which further the general purposes of this chapter in any way. In the event any regulation or standard provided in this chapter shall vary or differ from the same or similar standard or regulation of any other municipal ordinance, the more restrictive provision of such ordinances shall be deemed to control.
