This chapter shall govern all acts, conduct and usage of the parks and lands which shall be under the administration of the Mayor and Council of the Borough of Rockaway and the Director of the Department of Parks and Recreation as provided for and set forth herein and Chapter
201 of the Borough Code.
As used in this chapter, the following words, terms and their
derivations shall have the following meanings unless their use in
the text of this chapter clearly demonstrates a different meaning:
PARKS AND RECREATIONAL FACILITIES or PARK
Includes all public parks, playgrounds, athletic fields,
beaches, recreation facilities and parking lots publicly owned or
under the control or supervision of the Borough of Rockaway and all
property owned or under the control or supervision of the Borough
of Rockaway upon which the public is invited or upon which the public
is permitted and where individuals gather for recreational activities
and all areas adjacent to such lands or facilities, including but
not limited to any parking area, driveway or drive aisle.
In addition to the Borough Police Department, violations of
the provisions and requirements of this chapter may also be enforced
by any other authorized officer or official of the Borough authorized
or empowered to enforce the provisions of the Borough Code. Notwithstanding
and in addition to any other penalties, remedies or relief authorized
by law, any violation of this chapter shall also be subject to prosecution
and enforcement under any other applicable provision of the Borough
Code.
In addition to any other penalties as may be authorized by law
or pursuant to the Borough Code and except as otherwise specified
in any other provision of this chapter, any person found to be in
violation of any provision of this chapter shall, upon conviction,
for each such violation, be subject to a fine of not less than $250
nor more than $750 or imprisonment for a term of not more than 90
days.
Nothing in this chapter shall be construed as repealing or amending
any provision of any other municipal ordinance which, by its terms,
regulate, or set standards for use, activity or conduct in parks and
recreational facilities, or which further the general purposes of
this chapter in any way. In the event any regulation or standard provided
in this chapter shall vary or differ from the same or similar standard
or regulation of any other municipal ordinance, the more restrictive
provision of such ordinances shall be deemed to control.
