A. 
In accordance with the provisions of § 2322 of the Second-Class Township Code, 53 P.S. § 67322, as amended, no structure, facility, or utility may be constructed, erected, or placed upon, below, inside, or over any portion of a Township street except under such conditions, restrictions and regulations relating to the installation and maintenance thereof, as may be prescribed in permits and regulations set forth in this Part and granted by the Township for such purpose.
B. 
Permit application requirement. The applicant shall make a written application on forms prescribed by the Township which shall include the following:
(1) 
Application fee, inspection fee, and degradation fees as required by this Part.
(2) 
Plans in a form and number as required by the Roadmaster's Regulations and sufficiently demonstrating compliance with the Roadmaster's Regulations and applicable Township Construction Standard Details.
(3) 
Financial security in a form as determined by this Part.
(4) 
Insurance as may be required by the Roadmaster's Regulations.
(5) 
Street opening agreements as may be required by the Roadmaster's Regulations.
C. 
Any person maintaining pipes, lines or other underground facilities in or under the surface of any street may proceed with an opening without a permit when emergency circumstances demand the work to be done immediately, provided the permit could not reasonably and practically have been obtained beforehand. The person shall thereafter apply for a permit on the first regular business day on which the office of the Township Roadmaster is open for business, and said permit shall be retroactive to the date when the work was begun.
D. 
The Township Roadmaster may revoke a permit, upon serving of written notice to the permittee, for failure to adhere to permit conditions, excavation of an area greater than ten percent more than approved, or violations of any provisions of Township ordinances.
E. 
Fees. Degradation fees shall be imposed on a sliding scale by square yard of street surface opened in relation to the combination of material types disturbed and the number of years since the street was most recently constructed, reconstructed, or resurfaced. Degradation fees shall be based on all area opened, including additional area required by this Part for purposes of restoration.
