The adoption of this article is in accordance with Municipal
Home Rule Law § 10.
This article shall be known as and may be cited as "Local Law
No. 2 of 2022 for the Abolition of Village Justices and Court." The
purpose of this article is to abolish and terminate the Fairport Village
Court System.
The intent of the Board of Trustees of the Village of Fairport
is to abolish and terminate the Fairport Village Court System, Village
Justice, Acting Village Justice, and Court Clerk pursuant to its authority
under Village Law §§ 3-301, 3-302 and 3-303. It is
the intent of the Board of Trustees of the Village of Fairport to
terminate the Village Justice position, which is due for election
on November 8, 2022. The Village Justice position would continue until
December 31, 2022, when the present term is due to expire. On January
1, 2023, the Fairport Village Court System, inclusive of the Village
Justice, Acting Village Justice, and Court Clerk would cease to exist.
On or after January 1, 2023, all matters necessitating the intervention
of the local justice court system, both criminal and civil actions,
originating in the Village of Fairport or once adjudicated in the
Fairport Village Court System shall be docketed in the Town of Perinton
Justice Court by virtue of the Village of Fairport being located in
the aforementioned town pursuant to Village Law § 3-301.
Should any word, section, clause, paragraph, sentence, part
or provision of this article be declared invalid by a court of competent
jurisdiction, such determination shall not affect the validity of
any other part hereof.
All other local laws of the Village of Fairport which are in
conflict with the provisions of this article are hereby superseded
or repealed to the extent necessary to give this article force and
effect during its effective period.
This article shall take effect immediately upon filing with
the Secretary of State; provided, however, that such article is subject
to permissive referendum, and the Village Clerk shall forthwith proceed
to notice such fact and conduct such referendum if required by petition.
