A. 
It is the intent of the City of Buffalo, through the enactment of this chapter, to regulate instances of towing and booting in the City of Buffalo in order to promote safety and responsibility within the streets and highways of the City of Buffalo. The public interest is served by the licensing of towing and booting companies and vehicles in order to properly identify such operators and to protect the citizens of the City from abuse and mistreatment.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
BOOT OWNER
Includes anyone owning or operating or causing to be operated a motor vehicle boot for compensation within the City of Buffalo.
BOOTING
To attach, clamp, or affix a device, including, but not limited to, a booting device, onto a motor vehicle, thereby immobilizing or disabling the vehicle.
CITY
The City of Buffalo.
DEPARTMENT OF PERMIT AND INSPECTION SERVICES
The Commissioner of the Department of Permit and Inspection Services of the City of Buffalo or any other member of the Department designated by the Commissioner of the Department of Permit and Inspection Services to perform duties under this chapter.
DIVISION OF PARKING ENFORCEMENT
The Director of the Division of Parking Enforcement of the City of Buffalo or any other member of Division designated by the Director of the Division of Parking Enforcement to perform duties under this chapter.
OPERATOR
Includes any individual, firm, association, joint venture, partnership, group, corporation, any other legal entity or combination of entities that provide the service of moving a motor vehicle by another vehicle for hire or the storage of vehicles after towing, or the service of booting and shall include, without limitation, owners of towing trucks and owners of motor vehicle boots and their agents and employees.
PERSON
Includes any individual, partnership, firm, corporation, association, company or organization of any kind.
POLICE DEPARTMENT
The Commissioner of Police of the City of Buffalo or any other member of the Police Department designated by the Commissioner of Police of the City of Buffalo to perform duties under this chapter.
PRIVATELY OWNED REAL PROPERTY
Real property owned by any individual, firm, association, joint venture, partnership, group, corporation or any legal entity or combination of entities whatsoever, and shall include, without limitation, shopping centers, parking lots, vacant lots, apartment houses and land used for commercial purposes.
TOW TRUCK OWNER
Includes anyone owning and operating or causing to be operated a tow truck for compensation within the City of Buffalo.
TOWING (COMMERCIAL)
The moving or removing of disabled, illegally parked or abandoned motor vehicles or motor vehicles involved in accidents, for which there is direct or indirect compensation.
